Section 1. Recitals. The above recitals are true and correct. Section 2. Findings. The City Council hereby finds and the public convenience and necessity require that these proceedings to change the types of public facilities which the District may finance be conducted. Section 3. The District. The name of the area is Commu- nity Facilities District No. 88-1 of the City of Colton, and a description of the territory included within the District is set forth on Exhibit "A," attached hereto and incorporated herein by this reference. Section 4. Changes and Amendments. The City Council hereby orders that the Resolution of Intention and the Resolution of Formation be amended and that the types of public facilities which may be financed by the District from the proceeds of the District's previously issued bonds, be changed to include, but not be limited to all of the facilities set forth on Exhibit 11B,11 attached hereto and incorporated herein by this reference. Section 5. Public Hearing. A public hearing (the "Public Hearing") on the changes in the types of public facilities to be financed by the District and all other matters set forth in this Resolution of Consideration shall be held at 7:30 p.m. on March 3, 1992 in the City Council Chambers, 650 N. La Cadena Drive, Colton, California, or such other place as may be duly noticed. Section 6. Testimony. At the time and place of the Public Hearing, any persons interested, including taxpayers, prop- erty owners and registered voters within the District, may appear and be heard, and the testimony of all persons for or against making the changes in the types of facilities which may be financed by the District and all other matters set forth in this Resolution of Consideration will be heard and considered. Section 7. Protests. Any protests pertaining to the regularity or sufficiency of the proceedings shall be in writing and clearly set forth the irregularities and defects to which the objection is made. All written protests shall be filed with the City Clerk on or before the time fixed for the Public Hearing. Written protests may be withdrawn in writing at any time before the conclusion of the Public Hearing. If written protests against the changes in the types of public facilities which may be financed by the District are filed by fifty percent (50%) or more of the registered voters, or six (6) registered voters, whichever is greater, residing within the District, or owners of one-half (1/2) or more of the area of land included within the District and not exempt from the special tax, those changes in the types of facilities which may be financed by the District shall be eliminated from this Resolution of Consideration and shall not be KRW87313
