Section 1. Recitals. The above recitals are true and <br />correct. <br />Section 2. Findings. The City Council hereby finds and <br />the public convenience and necessity require that these proceedings <br />to change the types of public facilities which the District may <br />finance be conducted. <br />Section 3. The District. The name of the area is Commu- <br />nity Facilities District No. 88-1 of the City of Colton, and a <br />description of the territory included within the District is set <br />forth on Exhibit "A," attached hereto and incorporated herein by <br />this reference. <br />Section 4. Changes and Amendments. The City Council <br />hereby orders that the Resolution of Intention and the Resolution <br />of Formation be amended and that the types of public facilities <br />which may be financed by the District from the proceeds of the <br />District's previously issued bonds, be changed to include, but not <br />be limited to all of the facilities set forth on Exhibit 11B,11 <br />attached hereto and incorporated herein by this reference. <br />Section 5. Public Hearing. A public hearing (the <br />"Public Hearing") on the changes in the types of public facilities <br />to be financed by the District and all other matters set forth in <br />this Resolution of Consideration shall be held at 7:30 p.m. on <br />March 3, 1992 in the City Council Chambers, 650 N. La Cadena <br />Drive, Colton, California, or such other place as may be duly <br />noticed. <br />Section 6. Testimony. At the time and place of the <br />Public Hearing, any persons interested, including taxpayers, prop- <br />erty owners and registered voters within the District, may appear <br />and be heard, and the testimony of all persons for or against <br />making the changes in the types of facilities which may be financed <br />by the District and all other matters set forth in this Resolution <br />of Consideration will be heard and considered. <br />Section 7. Protests. Any protests pertaining to the <br />regularity or sufficiency of the proceedings shall be in writing <br />and clearly set forth the irregularities and defects to which the <br />objection is made. All written protests shall be filed with the <br />City Clerk on or before the time fixed for the Public Hearing. <br />Written protests may be withdrawn in writing at any time before the <br />conclusion of the Public Hearing. If written protests against the <br />changes in the types of public facilities which may be financed by <br />the District are filed by fifty percent (50%) or more of the <br />registered voters, or six (6) registered voters, whichever is <br />greater, residing within the District, or owners of one-half (1/2) <br />or more of the area of land included within the District and not <br />exempt from the special tax, those changes in the types of <br />facilities which may be financed by the District shall be <br />eliminated from this Resolution of Consideration and shall not be <br />KRW87313 <br />
