included in a resolution for a period of one year from the date of <br />the City Council's determination that such a protest exists. <br />Section 8. Notice of Hearing; Publication. The City <br />Clerk shall cause a notice of the Public Hearing to be published <br />once, at least seven (7) days prior to the Public Hearing, in the <br />Colton Courier, a newspaper of general circulation published in the <br />area of the District or such other newspaper of general circulation <br />published in the area of the District as the Clerk may select. The <br />City Clerk shall cause the notice of the Public Hearing to be given <br />by first-class mail to each registered voter and to each landowner <br />in the District at least fifteen (15) days prior to the Public <br />Hearing. The notice of the Public Hearing shall contain the <br />information specified as follows: <br />(a) The text of this Resolution of Consideration; <br />(b) The time and place of the Public Hearing; <br />(c) A statement that, at the Public Hearing, the <br />testimony of all interested persons or taxpayers for or <br />against the changes in the types of public facilities <br />which may be financed by the District will be heard. The <br />notice shall also describe in summary the effect of <br />protests made by registered voters or landowners against <br />the changes in the types of public facilities which may <br />be financed by the District. <br />(d) A description of the proposed voting procedure. <br />Section 9. Description of Voting Procedures. The voting <br />procedures to be followed in conducting the special election on the <br />proposition of the District being authorized to change the types of <br />public facilities which may be financed by the District (the <br />"Special Election") shall be as follows: <br />(a) If at the time of the close of the Public <br />Hearing (hereinafter referred to as the "Protest Hear- <br />ing") at least 12 persons are registered to vote within <br />the territory of the District, the Special Election shall <br />be conducted by the City Clerk and shall be held on a <br />date selected by the City Council in conformance with the <br />provisions of Section 53326 of the Act and pursuant to <br />the applicable provisions of the Uniform District Elec- <br />tion Law, Part 3 (commencing with Section 23500) of Divi- <br />sion 14 of the California Elections Code, insofar as they <br />may be applicable, and pursuant to said Section 53326 the <br />ballots for the Special Election shall be distributed to <br />the qualified electors of the District by mail with <br />return postage prepaid and the Special Election shall be <br />conducted as a mail -ballot election. <br />(b) If at the time of the close of the Protest <br />Hearing, and for at least the preceding 90 days, less <br />KRW87313 <br />
