9'. <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />be followed in connection with the Authority's various activities <br />and actions; and <br />WHEREAS, the Authority has previously sought approval <br />by all Members of different versions of Amendment No. 1 but has <br />been unable to obtain a consensus from all Members as to which <br />version is acceptable to all parties; and <br />WHEREAS, a copy of the proposed revised amendment <br />entitled Amendment No. 1 to Amended Joint Exercise of Powers <br />Agreement ("Amendment No. 111) is attached hereto as Exhibit "A" <br />and incorporated herein by this reference; and <br />WHEREAS, in accordance with the provisions of the <br />Amended Joint Exercise of Powers Agreement, any amendments to the <br />Amended Joint Exercise of Powers Agreement require the approval <br />of the Members of the Authority and, accordingly, the Authority <br />has requested that the City approve "Amendment No. 111; and <br />WHEREAS, the City has previously approved alternate <br />versions of Amendment No. 1 which did not contain all of the <br />changes now requested by the Authority and, accordingly, the City <br />now deems it necessary to rescind its prior approval of the first <br />version of Amendment No. 1 which was accomplished pursuant to <br />City Resolution No. R-120-91 as well as the second version of <br />Amendment No. 1 which was accomplished pursuant to City <br />Resolution No. R-12-92. <br />- 2 - <br />
