RESOLUTION NO. R-33-92 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, CALLING A SPECIAL ELECTION AND SUBMITTING TO THE VOTERS OF COMMU- NITY FACILITIES DISTRICT NO. 88-1 PROPOSITION WITH RESPECT TO AUTHORIZING A CHANGE IN THE TYPES OF PUBLIC FACILITIES WHICH MAY BE FINANCED WITHIN THE COMMUNITY FACIL- ITIES DISTRICT WHEREAS, the City Council (the "City Council") of the City of Colton (the "City") has previously conducted proceedings pursuant to Chapter 2.5 (commencing with Section 53311) of Part 1 of Division 2 of Title 5 of the California Government Code, com- monly known as the Mello -Roos Community Facilities Act of 1982, as amended (the "Act"), and in accordance therewith adopted Resolution No. R-82-88 on September 6, 1988, (the "Resolution of Formation") establishing Community Facilities District No. 88-1 of the City of Colton, County of San Bernardino, State of California (the "Community Facilities District"), and the boundaries thereof; and WHEREAS, on January 21, 1992 the City Council adopted Resolution No. R-11-92 pursuant to Section 53334 of the Act with respect to amending the Resolution of Intention and the Resolution of Formation by authorizing a change in the types of public facilities which may be financed by the Community Facilities District; and WHEREAS, pursuant to Sections 53331 and 53334 of the Act, the City Council has called and conducted a public hearing (the "Public Hearing") with respect to amending the Resolution of Inten- tion and the Resolution of Formation by authorizing a change in the types of public facilities which may be financed by the Community Facilities District; and WHEREAS, the City Council has determined that there was no majority protest; and WHEREAS, pursuant to Sections 53326 and 53338 of the Act, it is necessary that the City Council submit to the qualified elec- tors of the Community Facilities District at a special election to be held on June 16, 1992 (the "Special Election") the proposition with respect to authorizing the Community Facilities District to change the types of public facilities which may be financed by the Community Facilities District (the "Proposition"); NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, AS FOLLOWS: Section 1. Findings. The City Council finds that: (i) the foregoing recitals are true and correct; (ii) based upon the Certificate received from the Registrar of Voters for the County of San Bernardino, more than 12 persons have been registered to vote within the territory of the Community Facilities District KRW87345
