RESOLUTION NO. R-33-92 <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF COLTON, CALIFORNIA, <br />CALLING A SPECIAL ELECTION AND <br />SUBMITTING TO THE VOTERS OF COMMU- <br />NITY FACILITIES DISTRICT NO. 88-1 <br />PROPOSITION WITH RESPECT TO <br />AUTHORIZING A CHANGE IN THE TYPES OF <br />PUBLIC FACILITIES WHICH MAY BE <br />FINANCED WITHIN THE COMMUNITY FACIL- <br />ITIES DISTRICT <br />WHEREAS, the City Council (the "City Council") of the <br />City of Colton (the "City") has previously conducted proceedings <br />pursuant to Chapter 2.5 (commencing with Section 53311) of Part 1 <br />of Division 2 of Title 5 of the California Government Code, com- <br />monly known as the Mello -Roos Community Facilities Act of 1982, as <br />amended (the "Act"), and in accordance therewith adopted Resolution <br />No. R-82-88 on September 6, 1988, (the "Resolution of Formation") <br />establishing Community Facilities District No. 88-1 of the City of <br />Colton, County of San Bernardino, State of California (the <br />"Community Facilities District"), and the boundaries thereof; and <br />WHEREAS, on January 21, 1992 the City Council adopted <br />Resolution No. R-11-92 pursuant to Section 53334 of the Act with <br />respect to amending the Resolution of Intention and the Resolution <br />of Formation by authorizing a change in the types of public <br />facilities which may be financed by the Community Facilities <br />District; and <br />WHEREAS, pursuant to Sections 53331 and 53334 of the Act, <br />the City Council has called and conducted a public hearing (the <br />"Public Hearing") with respect to amending the Resolution of Inten- <br />tion and the Resolution of Formation by authorizing a change in the <br />types of public facilities which may be financed by the Community <br />Facilities District; and <br />WHEREAS, the City Council has determined that there was <br />no majority protest; and <br />WHEREAS, pursuant to Sections 53326 and 53338 of the Act, <br />it is necessary that the City Council submit to the qualified elec- <br />tors of the Community Facilities District at a special election to <br />be held on June 16, 1992 (the "Special Election") the proposition <br />with respect to authorizing the Community Facilities District to <br />change the types of public facilities which may be financed by the <br />Community Facilities District (the "Proposition"); <br />NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED BY <br />THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, AS FOLLOWS: <br />Section 1. Findings. The City Council finds that: <br />(i) the foregoing recitals are true and correct; (ii) based upon <br />the Certificate received from the Registrar of Voters for the <br />County of San Bernardino, more than 12 persons have been registered <br />to vote within the territory of the Community Facilities District <br />KRW87345 <br />
