RESOLUTION NUMBER R-33-92 Page 2 <br />for each of the 90 days preceding the close of the Public Hearing <br />held on March 3, 1992; (iii) pursuant to Section 53326 of the Act, <br />as a result of the finding set forth in clause (ii) above, the vote <br />in the Special Election called by this resolution shall be by the <br />registered voters residing within the Community Facilities <br />District, and each registered voter as of the close of the Public <br />Hearing shall have one vote; <br />Section 2. Call of Election. The City Council hereby <br />calls and schedules the Special Election for June 16, 1992, on the <br />Proposition. <br />Section 3. Proposition. The Proposition to be submitted <br />to the qualified electors of the Community Facilities District at <br />the Special Election shall be as follows: <br />Proposition A: Shall Community Facili- <br />ties District No. 88-1 of the City of Colton, <br />County of San Bernardino, State of California <br />(the "Community Facilities District") be <br />authorized to change the types of public <br />facilities which the Community Facilities <br />District was previously authorized to finance <br />to include the design, acquisition and/or <br />construction of the public facilities set <br />forth in Exhibit "B" to Resolution No. R-11- <br />92, which exhibit is incorporated herein by <br />this reference, as well as any other <br />facilities, equipment and incidental expenses <br />and costs within the Community Facilities <br />District, which pursuant to Chapter 2.5 <br />(commencing with Section 53311) of Part 1 of <br />Division 2 of Title 5 of the California <br />Government Code, commonly known as the Mello - <br />Roos Community Facilities Act of 1982, as <br />amended and applicable law the City is <br />authorized to contribute revenue to, <br />construct, own or operate? <br />The ballot for the Special Election shall be in <br />substantially the form set forth in Exhibit "A," attached hereto <br />and incorporated herein by this reference. <br />Section 4. Conduct of Election. Except as otherwise <br />provided in Section 5 hereof, the Special Election shall be con- <br />ducted by the City Clerk in accordance with the provisions of the <br />California Elections Code governing mail ballot elections of <br />cities, and in particular the provisions of Article 2 (commencing <br />with § 1340), Chapter 5, Division 2 of that Code, insofar as they <br />may be applicable. <br />KRW87345 <br />
