Section 2: overtime <br />A. 7K Exemption <br />The City of Colton has exercised its ability to take a <br />statutory 117K" exemption for shift personnel. The work period for <br />such employees shall be 27 days in length. <br />B. Workperiod <br />All employees required to perform in excess of the standard <br />work period of 204 hours in a 27 day cycle shall receive <br />compensation at the rate of time and one-half his/her regular rate <br />of pay for those hours in excess of 204. The regular rate of pay <br />shall include in addition to base salary education incentive and <br />longevity pay. <br />In determining an employee's eligibility for FLSA overtime <br />compensation in a work period, unpaid leaves of absence shall be <br />excluded from the total hours worked. Paid leave of absences shall <br />be included as hours worked for purposes of overtime compensation. <br />These leaves include, but are not limited to, the following: <br />1) vacation <br />2) Holiday Leave <br />3) Sick Leave <br />4) Administrative Leave <br />5) Compensatory Leave <br />6) Workers' Compensation Leave <br />7) 4850 Time <br />8) Jury Duty <br />9) Bereavement Leave <br />10) Military Leave <br />For overtime not otherwise paid at the time and on -half the regular <br />rate, an employee shall be paid straight time at his/her regular <br />salary rate. <br />Non -shift personnel (40 hour employees) shall be paid overtime <br />for all hours worked in excess of 40 during a seven day work period <br />at a rate of time and one-half the employee's regular rate of pay. <br />Notwithstanding the above, all hours worked on an emergency <br />callout basis shall be paid at time and one-half the 40 hour rate. <br />An employee called back to duty for an emergency callout shall be <br />paid a minimum of two hours at time and one-half the 40 hour rate, <br />in addition to payment for the actual hours worked. Travel time <br />shall not be considered hours worked and shall not be compensated <br />in any manner whatsoever. <br />An employee on call back shall not be eligible for an <br />additional call back bonus of two hours if he/she is dispatched to <br />another call prior to being released. <br />There shall be no pyramiding of overtime. Hours worked by an <br />employee in any workday, workweek, or workperiod on which premium <br />rates have been allowed shall not be used again in any other <br />overtime calculation other than computing total actual hours <br />-3- <br />
