Costs and Disbursements: <br />a) The City of Colton agrees to pay all costs and <br />disbursements incurred by us and reasonably required for the <br />preparation and prosecution of legal action on the City's claims, <br />or for claims against the City. This includes filing fees, <br />service fees, charges for deposition, investigators, copying <br />documents, jury fees, and fees for expert witnesses and <br />consultants. <br />b) In the event the City fails to pay any of the costs <br />mentioned above, we may (but are not obligated to) advance and pay <br />them on the City's behalf. Any such payments, however, shall be <br />repaid to us by the City immediately upon our demand, and without <br />regard to the outcome of the legal action on the City's behalf. <br />5.
