R-104-96 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON ESTABLISHING TERMS AND CONDITIONS <br />OF EMPLOYMENT OF THE CITY MANAGER <br />WHEREAS, the City of Colton ("City") is a general law city of the State of California; <br />WHEREAS, by Resolution No. R-112-94 and in accord with the provisions of the <br />California Government Code and with Chapter 2.16 of the Colton Municipal Code, the City <br />Council appointed Mr. Nabar Enrique Martinez as its City Manager to begin working for the <br />City on September 19, 1994; and <br />WHEREAS, the City Council finds and determines that it is appropriate that the City <br />Manager's terms and conditions of employment be reviewed and amended in accord with the <br />provisions of this resolution. <br />NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: <br />SECTION 1. The appointment of Nabar Enrique Martinez ("Martinez") as City Manager <br />of the City of Colton is hereby continued for an indefinite term in accord with the provisions <br />of Section 2.16.020 of the Colton Municipal Code. <br />SECTION 2. Upon adoption of this Resolution, the City Manager's salary shall be <br />increased to the amount of $105,000 annually, retroactive to September 19, 1995, in accord with <br />the letter of intent dated September 8, 1994 signed by interim City Manager William Winter on <br />behalf of the City. This increase is based upon the commitment made in the letter of intent and <br />not upon any performance review conducted by the City Council. The City Manager shall <br />continue to be entitled to City Executive Employee benefits as set forth in Resolution R-84-93 <br />
