In the event of termination of Nabar Enrique Martinez without cause under <br />the provisions of Section 2.16.020 of the Colton Municipal Code, Mr. Martinez shall be entitled <br />immediately upon such termination to severance pay equal to six months salary, exclusive of <br />benefits, together with all other accrued compensation due him at the time of such termination. <br />SECTION 4. The salary of the City Manager shall be reviewed in connection with a full <br />performance review on or before September 19, 1996, and shall be subject to a merit increase <br />of 5 % for the next twelve month period so long as the performance review confirms satisfactory <br />performance. <br />SECTION 5. The terms and conditions of employment set forth in this resolution are <br />intended to create a binding obligation on the part of the City of Colton and Mr. Martinez, and <br />it is hereby acknowledged that upon adoption of this resolution, the continued employment of <br />Mr. Martinez as City Manager for the City of Colton is expressly conditioned upon adherence <br />to the employment conditions set forth herein. <br />SECTION 6. The faithful performance bond posted by Mr. Martinez shall be continued <br />in effect as required by the Colton Municipal Code Section 2.16.040 in the amount of $10,000. <br />PASSED, APPROVED AND ADOPTED this 25th day of October, 1995. <br />ATTEST: <br />Helen Ramos, City Clerk <br />
