R- 59-95 <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF COLTON, ADOPTING THE ALTERNATIVE <br />PROCEDURE SET FORTH IN PUBLIC UTILITIES CODE <br />SECTION 21670.1 <br />WHEREAS, Public Utilities Code Section 21670 et. seq. provides <br />for the establishment of an Airport Land Use Commission (ALUC) in every <br />county in which there is located an airport which is served by a scheduled <br />airline; and <br />WHEREAS, prior to passage of Senate Bill 443 (enacted and <br />effective June 30, 1993), section 21670(b) of the Public Utilities Code <br />provided that each county "shall" establish a commission in such <br />circumstances; and <br />WHEREAS, Senate Bill 443 amended section 21670(b) to change <br />the term "shall' to "may' in order to relieve local entities such as the <br />County of the duty to incur unnecessary expenses in certain aspects of <br />airport land use: and <br />WHEREAS, the County Board of Supervisors, by adoption of <br />Resolution No. 93-295 on October 19, 1993, withdrew from the Joint <br />Powers Agreement (JPA) which established on the East, West, and <br />Mountain/Desert Planning Agencies - Airport Land Use Commissions; and <br />WHEREAS, the State of California no longer reimburses San <br />Bernardino County for administration of the ALUC Program; and <br />WHEREAS, Assembly Bill No. 2831 (effective January 1, 1995), <br />amended section 21670(b) to change the term "may" to "shall' in order to <br />reinstate the requirement that local entities establish an ALUC; and <br />WHEREAS, Assembly Bill No. 2831 amended Public Utilities Code <br />section 21670.1 to provide an alternative procedure to the requirement for <br />the establishment of an ALUC which allow local jurisdictions to make land <br />use decisions for areas within a public use airport sphere of influence as <br />designated by the Comprehensive Airport Land Use Plan (CALUP); and <br />
