5. The Association agrees to modifying the parity language in the <br />M.O.U. as follows: "During the term of this agreement Section 10 in <br />the consolidated MOU dealing with Internal Parity will not apply <br />unless any other bargaining unit receives across the board cost of <br />living adjustment (COLA) placing them above the average as detailed <br />in the Hayhurst and Associates Compensation Study. In this case the <br />members of these bargaining units shall receive the same increase." <br />6. The Association agrees to modify work hours so that utility payments <br />and "turn on" are available on Fridays. Work hours for employees <br />assigned to Fridays in Financial will be from 9-2 p.m. effective <br />September 11, 1998. The ability to "trade" Fridays worked will be <br />available subject to the following conditions: The practice of shift <br />trading shall be voluntary on behalf of each employee involved in <br />the trade. An employee must have supervisory approval prior to <br />being allowed to trade shifts. The trade must be due to the <br />employee's desire or need to attend to a personal matter and not due <br />to the department's operations. The employee providing the trade <br />shall not have his/her compensable hours increased as a result of <br />the trade; nor shall the employee receiving the trade have his/her <br />compensable hours decreased as a result of the trade. Any hours <br />worked beyond the normal workday will be credited to the individual <br />actually doing the work. "Paybacks" of shift trades are the <br />obligation of the two employees involved in the trade. Any dispute <br />as to paybacks is to be resolved by the involved employees, and <br />under no circumstances will the department be obligated for any <br />further compensation whatsoever to any of the involved employees. <br />The department is not responsible in any manner for hours owed to <br />employees by other employees that leave the employment of the City <br />or are assigned other duties. If one individual fails to appear for <br />the other (regardless of reason), the person who "traded in" will be <br />listed as absent without leave and may be subject to disciplinary <br />action. <br />The City agrees to the "open Fridays" as a"pilot" program and after <br />(6) six months will reevaluate if it is effective and will discuss <br />whether they will continue the program with the Association. <br />7. The City agrees to provide "prorated" insurance contributions for <br />(3) three part time employees in the Finance Department, (1) one <br />part-time employee in the Public Works Department, (1) one part-time <br />employee in the City Manager's Department, and (1) one employee in <br />the City Clerks Department who work over 20 hours per week. <br />8. Conclusiveness of Memorandum of Understanding: The parties <br />acknowledge that during the negotiations which resulted in this MOU, <br />each had the right and opportunity to make demands and proposals <br />11/10/98 <br />MOU General Exhibit A 98 <br />
