R-45-98 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, INITIATING PROCEEDINGS FOR THE FORMATION AND ANNUAL <br />LEVY OF THE CITYWIDE LANDSCAPE MAINTENANCE DISTRICT PURSUANT TO <br />THE LANDSCAPING AND LIGHTING ACT OF 1972. <br />The City Council of the City of Colton, California does resolve as follows: <br />WHEREAS, The City Council of the City of Colton, confirms the area known as the Citywide <br />Landscape & Lighting District is within the boundaries of the City of Colton; <br />WHEREAS, The City Council of The City of Colton may be authorized to provide for thel <br />levy and collection of annual assessments by the County of San Bernardino under provisions of the <br />Landscape and Lighting Act of 1972, Part 2 (commencing with section 22500) of Division 15 of the'i <br />California Streets and Highways Code (the Act); to pay for the improvements, operation, maintenance', <br />and services for street trees, parkways, median islands, perimeter landscaping, open space, drainage <br />area, entry wall, signage, concrete pathway, street lights and all appurtenant facilities and operations <br />related thereto. <br />WHEREAS, the City of Colton has retained Muni Financial Services, Inc. (MFS), for the <br />purpose of assisting with the Formation of the Citywide Landscape Maintenance District (District), the <br />Annual Levy of the District, and to prepare and file a report with the District Clerk in accordance with <br />the Act. <br />NOW, THEREFORE, BE IT RESOLVED, DETERMINED, AND ORDERED BY <br />THE CITY OF COLTON, CALIFORNIA, AS FOLLOWS: <br />Section 1. Intention. The City Council hereby declares that it is its intention to seek the Formation and <br />Annual Levy of the District pursuant to the Act, over and including the land within the District <br />boundary, and to levy and collect annual assessments on all such land to pay the costs of the following: <br />operation, maintenance and services for street trees, parkways, median islands, perimeter landscaping, <br />slopes, open space and all appurtenant facilities and operations related thereto, as well as the servicing <br />and maintenance of street lights and operations related thereto. <br />Section 2. Boundaries and Designation. The boundaries of the District are described as the <br />boundaries of the City of Colton set in the Annual Levy Report of the District within the City of <br />Colton, County of San Bernardino, State of California. The following locations are being added to <br />zone #4 Old Colton: <br />The Grade Separation on Olive Street - Landscape Maintenance <br />The Grade Separation on "C" Street - Landscape Maintenance <br />
