CITY OF COLTON <br />INTEROFFICE MEMORANDUM <br />TO: Henry Garcia, City Manager <br />FROM: Carolina P. Barrera, City Clerk <br />SUBJECT: Appeal of Planning Commission Decision <br />DATE: September 14, 1998 <br />At the Council Meeting of July 7, 1998 a Public Hearing was opened regarding the Reche Canyon <br />Rehabilitation, Inc., Parking Lot Project This was an appeal of the Planning Commission's <br />decision to uphold conditions of approval. <br />This item was continued to the August 4, 1998 meeting. As of this date this item has not returned <br />for consideration of the appeal request. <br />I have discussed this with and you believed that it would be resolved internally and therefore the <br />item would not be agendized. <br />There is an ordinance in place which requires action by Council to overturn or uphold upon request <br />for appeal of a decision made by the Planning Commission. I have reviewed this with the City <br />Attorney and she is in agreement that this item has to be resolved to overturn or uphold. The <br />ordinance also has a time line which has expired. (Municipal Code § 18.5 8.070) <br />Please confer with legal counsel as to action that shall be taken in order to resolve this unfinished <br />business. <br />Cb <br />
