R-84-98 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON APPROVING TOW TRUCK FRANCHISE <br />AGREEMENTS <br />WHEREAS, for the protection of health, safety and welfare the City of Colton ("City") <br />has decided to grant franchises to private tow truck operators to provide tow truck services within the <br />boundaries of the City to the City on an as needed basis; and <br />WHEREAS, the City Council appointed a Tow Services Ad Hoc Committee to review <br />tow truck services and regulations; and <br />WHEREAS, the Ad Hoc Committee has met and has decided to recommend to the <br />City Council that the City enter into tow franchise agreements; one with Pepe's Towing Service Inc. <br />and the other with Patriot Towing, dba Whitehouse Enterprises Inc. which both operate towing yards <br />within the boundaries of the City; and <br />WHEREAS, the Ad Hoc Committee further decided to recommend that the City <br />Council adopt an ordinance pertaining to the regulation of tow truck franchisees and the criteria to <br />select additional franchisees that may or may not operate within the City; and <br />WHEREAS, the City Council has accepted the recommendation of the Ad Hoc <br />Committee and finds that the approval of the franchise agreements with Pepe's and Patriot in the forms <br />attached hereto as Exhibit A and Exhibit B, respectively, are in the best interest of the City in that the <br />City's police department will call upon the franchisees to provide service within the City and these <br />operators will dispatch services from within the City; and <br />WHEREAS, the City currently has a need for up to four (4) tow truck operators and <br />has continuously done business with two operators who are located outside of the City's boundaries; <br />and <br />WHEREAS, the Ad Hoc Committee has determined that it would be in the City's best <br />interest to continue working with a total of four operators until the City Council adopts an ordinance <br />concerning the criteria to select additional franchisees, and <br />WHEREAS, the Ad Hoc Committee has recommended that the two current operators <br />who have not been awarded franchise agreements continue service until additional franchisees are <br />selected. <br />BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />1. The City Council hereby approves the franchise agreements with Pepe's Towing <br />Service, Inc. and Patriot Towing, dba Whitehouse Enterprises, Inc. attached hereto as Exhibits A and <br />B, respectively. <br />RVPUS\SRC146695 <br />
