is based on the union agreeing to amend Article V, Section 1 of the MOU dealing with <br />Staffing by modifying the number of personnel per shift from 17 to 15. This reduction of <br />personnel shall be implemented as follows: <br />No earlier than January 1, 2001 personnel per shift shall be reduced from 17 to <br />16; No earlier than July 1, 2001 personnel per shift shall be reduced from 16 to <br />15. This reduction in personnel shall be achieved through vacancies created by <br />normal attrition and shall not be created by the layoff of any unit member. <br />Nothing contained herein shall reduce the "minimum assignment" for equipment <br />staffing as designated in Article V, Section 1. Since the City's proposal is based <br />on saving s achieved by a reduction in staffing, if in the future the Union <br />proposes increasing the number of staff provided for in Article V, Section 1 of <br />the MOU, they also agree to meet and confer with the City on Article III, Section <br />3 of the MOU dealing with the City paying the employee's share of the PERS <br />contribution. Further, should the PERS 3% at 50 -retirement program be held <br />invalid for any reason, the City agrees to meet and confer with the Union on <br />Article V, Section 1, of the MOU dealing with the restoration of staffing to <br />previous levels. <br />Nothing contained herein shall require meet and confer of the MOU for any staffing <br />increases proposed by the City or its' designee. Further, the meet and confer process <br />shall not be required due to Union endorsement of any City proposed staffing increases. <br />V. SAVINGS CLAUSE: Should any provision of this agreement be held invalid by <br />a court of competent jurisdiction, then the remaining provisions shall remain in full force <br />and effect. <br />VI. MAINTENANCE OF BENEFITS: All other terms and conditions of <br />employment in existence immediately prior to the effective date of this MOU and not <br />altered by this MOU, shall remain the same, unchanged, and in full force and effect <br />unless altered by the mutual agreement of the City and the Union. <br />VII. WAIVER CLAUSE: Except as stated in other portions of this MOU the City and the <br />Union, for the life of this MOU, each agrees that the other shall not be obligated to meet and <br />confer with respect to any subject or matter referred to or covered in this MOU.
