is based on the union agreeing to amend Article V, Section 1 of the MOU dealing with Staffing by modifying the number of personnel per shift from 17 to 15. This reduction of personnel shall be implemented as follows: No earlier than January 1, 2001 personnel per shift shall be reduced from 17 to 16; No earlier than July 1, 2001 personnel per shift shall be reduced from 16 to 15. This reduction in personnel shall be achieved through vacancies created by normal attrition and shall not be created by the layoff of any unit member. Nothing contained herein shall reduce the "minimum assignment" for equipment staffing as designated in Article V, Section 1. Since the City's proposal is based on saving s achieved by a reduction in staffing, if in the future the Union proposes increasing the number of staff provided for in Article V, Section 1 of the MOU, they also agree to meet and confer with the City on Article III, Section 3 of the MOU dealing with the City paying the employee's share of the PERS contribution. Further, should the PERS 3% at 50 -retirement program be held invalid for any reason, the City agrees to meet and confer with the Union on Article V, Section 1, of the MOU dealing with the restoration of staffing to previous levels. Nothing contained herein shall require meet and confer of the MOU for any staffing increases proposed by the City or its' designee. Further, the meet and confer process shall not be required due to Union endorsement of any City proposed staffing increases. V. SAVINGS CLAUSE: Should any provision of this agreement be held invalid by a court of competent jurisdiction, then the remaining provisions shall remain in full force and effect. VI. MAINTENANCE OF BENEFITS: All other terms and conditions of employment in existence immediately prior to the effective date of this MOU and not altered by this MOU, shall remain the same, unchanged, and in full force and effect unless altered by the mutual agreement of the City and the Union. VII. WAIVER CLAUSE: Except as stated in other portions of this MOU the City and the Union, for the life of this MOU, each agrees that the other shall not be obligated to meet and confer with respect to any subject or matter referred to or covered in this MOU. However, they may meet by mutual agreement or as required by Government Code, Section 3504.5.
