1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />]S <br />191 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />j I Section 9525 of the Refunding Act were and have been duly satisfied, and that the City is <br />authorized to act upon said report without notice and hearing as otherwise required by the <br />Refunding Act; and <br />WHEREAS, said report was thereafter adopted, approved and confirmed by the <br />City Council, and the reassessments, not to exceed the amounts as contained therein, were <br />I thereby confirmed and levied by the City Council; and <br />WHEREAS in furtherance of implementing the refinancing, there has been filed <br />with the City Clerk for consideration and approval by the City Council a form of the Fiscal <br />Agent Agreement under the terms of which the City of Colton, Limited Obligation Refunding <br />Bonds, Reassessment District No. 00-1 (Rancho Mediterrania Project) (the "Refunding <br />Bonds"), are to be issued; and <br />WT -AREAS, the City has determined to sell the Bonds to Wedbush Morgan <br />Securities (the "Underwriter") pursuant to a Purchase Contract ("Purchase Contract"), said <br />form is on file with the City Clerk and presented to this meeting; and <br />WHEREAS, in connection with implementation of the issuance and sale of the <br />Refunding Bonds, there has been filed with the City Clerk for consideration and approval by <br />this City Council a form of official statement (the "Official Statement"), describing the <br />proposed issuance and sale of the Refunding Bonds; and <br />WHEREAS, in furtherance of implementing the refinancing, there has been <br />filed with the City Clerk for consideration and approval by the City Council a form of the <br />Escrow Agreement under the terms of which the Prior Bonds are to be redeemed; and <br />WHEREAS, in order to facilitate the sale of the Refunding Bonds, the City will <br />provide the Underwriter with a continuing disclosure agreement (the "Continuing Disclosure <br />Agreement"), the form of which is now on file with the City Clerk; and <br />3 <br />
