I RESOLUTION NO. R-106-01 <br />2 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />3 COUNTY OF SAN BERNARDINO STATE OF CALIFORNIA, AMENDING <br />4 RESOLUTION R-22-99 TO THE FIVE-YEAR CAPITAL IMPROVEMENT <br />PROGRAM AND TWENTY-YEAR TRANSPORTATION PLAN. <br />5 WHEREAS, the City Council by Resolution No. R-22-99, based on good faith reliance <br />6 <br />7 adopted the Five -Year Capital Improvement Program and Twenty -Year Transportation Plan. <br />8 WHEREAS the City Council is now aware of "a mistake of fact" in that the City made <br />9 expenditures from the Measure I fund for project not shown on the Five -Year Capi <br />10 Improvement Plan. Measure I requires that all expenditures of Measure I revenue be bas <br />11 upon the Five -Year Capital Improvement Plan. The City Council wishes to amend sE <br />12 Resolution No. R-22-99 to be in compliance with Measure I requirements by adding the f <br />13 <br />14 199/2000 Pavement Rehabilitation Program, in the amount of $102,503 to the Measure I Fiv <br />15 11 Year Capital Improvement Program and Twenty -Year Transportation Plan, Exhibit A. <br />16 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Coltoi <br />17 resolves as follows, the local project, FY 1999/2000 Pavement Rehabilitation Phase I. bo <br />18 included in the Measure I Five -Year Capital Improvement Program, Exhibit A. It is furthe <br />19 <br />20 resolved that this amendment is effective on adoption and amends and supercedes Resolutior <br />21 R-22-99 where inconsistent therewith. <br />22 PASSED, APPROVED, AND ADOPTED, this 6th day of November 2001. <br />23 <br />24 <br />25 DEIRDRE H.
