R-35-01 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />EXPRESSING THE CITY'S COMMITMENT TO ADDRESS THE STORM <br />DRAINAGE ISSUES PREVALENT ON THE WEST END OF THE CITY OF <br />COLTON <br />WHEREAS, on October 26, 1988, the City Council of the City of Colton adopted Ordinance No. 0-27-88 <br />relating to the levy of storm drain facilities fees for Drainage Benefit Area No. 1, which is comprised of the property in <br />the west end of the City of Colton within San Bernardino County Flood Control Study Zone 2; and <br />WHEREAS, in recognition of the immediate and significant need for new storm drain facilities to serve <br />property within San Bernardino County Flood Control Study Zone 2, the San Bernardino County Flood Control <br />District, the City of San Bernardino, the City of Rialto and the City of Colton have agreed to participate in the funding <br />of a storm drain improvement system know as CSDP Project 3-5 ("Project 3-5°); and <br />WHEREAS, the storm drain improvements planned for Project 3-5 consist of a series of contiguous storm <br />drain improvements running from the East Rialto Channel and Pepper Avenue Basin, on the north, to the Santa Ana <br />River, on the south; and <br />WHEREAS, the Project 3-5 storm drain improvements are necessary to adequately and efficiently remove <br />surface and storm waters generated within the cities of San Bernardino, Rialto, Colton and the County of San <br />Bernardino; and <br />WHEREAS, the development fees collected pursuant to Ordinance No. 0-27-88 are intended to fund the <br />City of Colton's fair share of the cost of construction of the Project 3-5 storm drain improvements; and <br />WHEREAS, to date, the funding required for the Project 3-5 storm drain improvements has not been <br />collected or committed for the project and these essential improvements have not been constructed; and <br />WHEREAS, the lack of adequate and effective storm drain improvements to serve the property within the <br />San Bernardino County Flood Control Study Zone 2 has created significant flooding problems within the City of <br />Colton, predominantly in the west and through no fault of the City; and <br />WHEREAS, the flooding problem is often exacerbated by new development occurring in neighboring <br />jurisdictions, such as the cities of San Bernardino and Rialto and the County of San Bernardino, and the construction <br />of deficient storm drain improvements that may be adequate in serving the particular development, but are <br />inadequate and ineffective in protecting downstream areas, such as the City of Colton; and <br />Page 1 <br />
