A copy of the Deferral Agreement in the <br />form submitted to the City Council at the public meeting is on <br />file with the City Clerk. The City Council hereby finds and <br />determines that: <br />(i) the terms and conditions of the Deferral Agreement <br />contain assurances that the Developer will perform any <br />obligation it may have to pay certain development impact fees <br />or construct certain off-site public improvements required by <br />the City as conditions of approval of a land development permit <br />application to be submitted by the Developer related to the <br />Project; <br />(ii) the Deferral Agreement will materially benefit and <br />assist the community to alleviate blighting conditions caused <br />by the underutilization of parcels and will expand employment <br />opportunities for residents of the City of Colton. <br />Section 3. The City Council hereby finds and <br />determines that no further environmental review by the City of <br />the Deferral Agreement is necessary under the California <br />Environmental Quality Act ("CEQA") as the City Council finds <br />and determines that: (i) the Property is situated in the <br />redevelopment project area of the west Valley Redevelopment <br />Project; (ii) a Program EIR was certified by the City of Colton <br />in conjunction with the adoption of the Redevelopment Plan for <br />the West Valley Redevelopment Project; (iii) the Deferral <br />Agreement does not propose any substantial changes in the <br />
