1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />211 <br />24 <br />25 <br />26 <br />27 <br />28 <br />site public improvements required by the City as conditions of <br />approval of a land development permit application to be <br />submitted by the Developer related to the Project; and <br />WHEREAS, the Agency will guaranty the performance of <br />certain potential conditions of the City's approval of a land <br />development permit application regarding the Project to be <br />submitted by the Developer, if the Developer does not perform <br />the obligations; and <br />WHEREAS, the Agency and the Developer have submitted a <br />proposed Development Impact Fee and Off -Site Public Improvement <br />Deferral Agreement (Moss Colton Properties, LLC) between the <br />City, the Agency and the Developer (the "Deferral Agreement") <br />setting forth the specific terms of the deferral of certain <br />potential conditions of the City's approval of a land <br />development permit application regarding the Project to be <br />submitted by the Developer and the Agency's guaranty of such <br />obligations; and <br />WHEREAS, it is appropriate for the City Council to <br />consider and act upon the proposed Deferral Agreement; <br />NOW, THEREFORE, BE IT RESOLVED AND DETERMINED BY THE CITY <br />COUNCIL OF THE CITY OF COLTON, AS FOLLOWS: <br />Section 1. On June 5, 2001, the City Council <br />considered the Deferral Agreement conducted at a public <br />meeting.
