R-57-01 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON APPROVING THAT CERTAIN AMENDMENT NO. 1 TO <br />THE PARTICIPATION AGREEMENT BY AND AMONG THE <br />REDEVELOPMENT AGENCY FOR THE CITY OF COLTON, THE <br />CITY OF COLTON AND EAST VALLEY LAND COMPANY <br />WHEREAS, the Redevelopment Agency for the City of <br />Colton (the "Agency"), the City of Colton (the "Colton") and <br />the East Valley Land Company ("EVLC"), entered into that <br />certain Participation Agreement dated August 13, 1998 (the <br />"Participation Agreement"); and <br />WHEREAS, the Participation Agreement contains a <br />definition of Public Improvements that excludes the <br />relocation, undergrounding or construction and <br />reconstruction of utilities from said definition; and <br />WHEREAS, the Participation Agreement also excludes from <br />the definition of Public Improvements any construction or <br />installation of railroad tracks, railroad spurs, railroad <br />lines or other similar improvements; and <br />WHEREAS, the Participation Agreement establishes a <br />formula for determining the amount of the Agency Cash <br />Contribution and the purposes for which EVLC may use and <br />apply the Agency Cash Contribution; and <br />WHEREAS, the parties deem it desirable at this time to <br />fix the precise aggregate dollar amount of the Agency Cash <br />Contribution and expand the purposes for which the Agency <br />-1- <br />
