EXHIBIT A <br />receiving the decision of the City Manager, submit a written request to the <br />City Manager for the grievance to be heard by an arbitrator. <br />B. Selection of Arbitrator — If the parties are unable to mutually select an <br />arbitrator, the State Mediation and Conciliation Service shall be requested <br />to submit a list of seven persons qualified to act as arbitrators. Within five <br />days following receipt of the list of arbitrators, the parties shall select an <br />arbitrator. Unless the parties agree to another method of selecting an <br />arbitrator, the parties shall alternately strike one name from the list until <br />one name remains. The right to strike the first name is determined by lot. <br />C. Private Hearing - Grievance arbitration hearing shall be private. <br />D. Cost and Expenses — Each party shall bear equally the cost of the fees and <br />expenses of the arbitrator and court reporter, if any. Each party shall bear <br />its own witness and attorney fees. <br />E. The arbitrator shall render a decision in writing within 30 days of the close <br />of the hearing or of his/her receipt of closing briefs, whichever is later. <br />The decision of the arbitrator is final and binding and is not subject to any <br />administrative or judicial review except pursuant to the Civil Code <br />Procedure Section 1286.2." <br />XI. SALARY: The City will provide to all unit employees a base salary increase of <br />5.5% effective July 1, 2001. The City will contract with a mutually agreed upon <br />consultant to complete a compensation study and will implement the <br />compensation study effective January 1, 2002, and will provide a 4% salary <br />increase to unit employees effective July 1, 2002. In addition, the City will <br />provide to all unit employees a COLA increase tied to the current Consumer Price <br />Index or a minimum of 2.5% effective July 1, 2003. The City agrees to re -open <br />for the purpose of meet and confer on City provided PERS Health coverage in <br />year 3. The aforementioned compensation increase in year 3, may or may not be <br />implemented, depending on the outcome of any meet and confer process. <br />XII. OVERTIME PAY: The City will pay overtime worked by employees in the unit <br />at the rate of 1.5 (time and one-half) with a $1.00 per hour differential for <br />overtime worked between the hours of 10 p.m. and 4 a.m. <br />XIII. COMPENSATORY TIME OFF: The accrual of compensatory time off will be <br />increased from 40 hours to 80 hours during the fiscal year on a premium rate <br />basis. Employees may bank up to the 80 hours accrued and may cash -out up to <br />40 hours per fiscal year within the current restrictions regarding use of <br />compensatory time off. <br />XIV. REST PERIOD: Language will be added as follows: <br />1. An employee who works sixteen consecutive hours shall earn an eight hour <br />rest period. <br />
