EXHIBIT A <br />THE CITY OF COLTON MEMORANDUM OF <br />UNDERSTANDING BY AND BETWEEN THE SAN <br />BERNARDINO PUBLIC EMPLOYEES ASSOCIATION <br />(SBPEA) MID MANAGER EMPLOYEES UNIT <br />AND THE CITY OF COLTON <br />This document contains a summary of the modification to the wages, hours and other <br />terms and conditions of employment of City of Colton SBPEA Mid Manager Unit <br />members which have been negotiated pursuant to Government Code Section 3500, et <br />seg. Which is generally referred to as the Meyers-:Milias-Brown Act. These <br />modifications shall be incorporated in a Memorandum of Understanding (MOU) upon the <br />approval of the City Council of the City of Colton and ratification by the Association and <br />will be placed into effect upon the adoption of the necessary ordinances and resolutions <br />by the City Council, if acceptable to them, in accordance with the terms and conditions <br />herinafter set forth. <br />I. TERM OF AGREEMENT: The agreement will last for a two year period <br />beginning July 1, 2001 and ending midnight June 30, 2003. <br />II. INTERNAL PARITY CLAUSE: The internal parity clause shall be removed <br />from the MOU. <br />III. GRIEVANCE DEFINITION: The definition of grievance in the Grievance <br />Procedure will be narrowed to include only violations or non-compliance with the <br />provisions of the MOU and City of Colton's written or unwritten Personnel Rules <br />and Regulations. <br />IV. HEALTH INSURANCE: The City agrees to initiate PERS Health Coverage at the <br />earliest possible implementation date, on or before December 1, 2001. A monthly <br />stipend in the amount of $675 will be established in lieu of the current health <br />insurance subsidy. Modifications to method of insurance delivery will be made <br />contingent upon PERS requirements for employer contribution amount for <br />employees and retirees as appropriate. <br />V. OVERTIME PAY: Article II, Section 3, Sub -section 1 language will be revised <br />to eliminate "seven(7) day cycle" language and replaced with "seven(7) day work <br />period". <br />VI. UNION AND CITY PROPOSALS: Due date for Union and City proposals will <br />be 90 days prior to the expiration of the MOU. <br />VII. FISCAL YEAR: Change leave (i.e. floating holiday, bereavement leave, etc.) <br />tuition, and <br />employees. <br />optical reimbursement to fiscal year with no adverse impact to <br />
