R-11402 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, PURSUANT TO GOVERNMENT CODE SECTION 21025, MAKING DETERMINATION OF DISABILITY STATUS FOR LOCAL SAFETY EMPLOYEE CLORINDA A. VALADEZ (formerly MARTINEZ) WHEREAS, the City of Colton (hereinafter referred to as Agency) is a contracting agency of the Public Employees' Retirement System; and WHEREAS, The Public Employees' Retirement Law requires that a contracting agency determine whether an employee of such agency is in employment in which she is classified as a local safety member; is disabled for purposes of Public Employees' Retirement Law; and, whether such disability is "industrial" within the meaning of such law; and, WHEREAS, the City Council confirms that a Worker's Compensation Claim was filed by Clorinda A. Valadez (formerly Martinez) alleging disability from her position as Police Officer; and, WHEREAS, the City Council has reviewed the medical and other evidence relevant to such alleged disability; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: The City of Colton hereby finds and determines that Clorinda A. Valadez (formerly Martinez) is incapacitated within the meaning of the Public Employees' Retirement Law for performance of her duties in the position of Police Officer, that the disability was the result of bodily injury by a vehicle operated by a drunk driver therefore it is a direct consequence of a violent act perpetrated upon her person under the provisions of Government Code Section 21417; and, BE IT FURTHER RESOLVED that the City Council finds and determines that such disability is a result of injury arising out of and in the course of employment.
