R-11402 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, CALIFORNIA, PURSUANT TO GOVERNMENT <br />CODE SECTION 21025, MAKING DETERMINATION OF <br />DISABILITY STATUS FOR LOCAL SAFETY EMPLOYEE <br />CLORINDA A. VALADEZ (formerly MARTINEZ) <br />WHEREAS, the City of Colton (hereinafter referred to as Agency) is a contracting <br />agency of the Public Employees' Retirement System; and <br />WHEREAS, The Public Employees' Retirement Law requires that a contracting <br />agency determine whether an employee of such agency is in employment in which she is <br />classified as a local safety member; is disabled for purposes of Public Employees' Retirement <br />Law; and, whether such disability is "industrial" within the meaning of such law; and, <br />WHEREAS, the City Council confirms that a Worker's Compensation Claim was filed <br />by Clorinda A. Valadez (formerly Martinez) alleging disability from her position as Police <br />Officer; and, <br />WHEREAS, the City Council has reviewed the medical and other evidence relevant to <br />such alleged disability; <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />The City of Colton hereby finds and determines that Clorinda A. Valadez (formerly <br />Martinez) is incapacitated within the meaning of the Public Employees' Retirement Law for <br />performance of her duties in the position of Police Officer, that the disability was the result of <br />bodily injury by a vehicle operated by a drunk driver therefore it is a direct consequence of a <br />violent act perpetrated upon her person under the provisions of Government Code Section <br />21417; and, <br />BE IT FURTHER RESOLVED that the City Council finds and determines that such <br />disability is a result of injury arising out of and in the course of employment.
