Valadez (formerly Martinez) nor the City of Colton has applied to the Worker's <br />Compensation Appeals Board for a determination pursuant to Section 21025 whether such <br />disability is industrial; and, <br />BE IT FURTHER RESOLVED that the member is separated from her employment in <br />the position of Police Officer after expiration of her leave rights underSection 21025.4 of the <br />Government Code, effective 09/29/02 and that no dispute as to the expiration of such <br />leave rights is pending; and, <br />BE IT FURTHER RESOLVED that there is a possibility of a third party liability; and <br />BE IT FURTHER RESOLVED that the primary disabling condition is orthopedic.
