1 RESOLUTION NO. R-21-02 <br />2 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />3 CALIFORNIA ADOPTING CERTAIN NEW CHARGES FOR VARIOUS POLICE <br />AND CODE ENFORCEMENT SERVICES PROVIDED BY THE CITY <br />4 <br />5 <br />WHEREAS, the City of Colton (the "City") finds that the enforcement of the Colton <br />6 <br />7 Municipal Code ("Municipal Code") throughout the City is an important public service; and <br />8 WHEREAS, enforcement of the Municipal Code, including its prohibition against <br />9 disturbing the peace, is vital to the protection of the public's health, safety and quality of life; <br />and <br />10 <br />WHEREAS, the City is authorized by California Government Code Section 38771 et <br />11 <br />seg. and the City's constitutional police powers to collect the direct and administrative costs of <br />12 <br />abating per se public nuisances; and <br />13 <br />14 WHEREAS, on January 15, 2002, the City Council adopted an ordinance, now codified <br />15 as Section 9.16.010 of the Municipal Code, authorizing the City to collect costs incurred by the <br />16 City in responding to repeated public nuisances created by disturbances of the peace as <br />defined in Section 9.16.010 of the Municipal Code; and <br />17 <br />18 WHEREAS, pursuant to Municipal Code Section 9.16.010(C)(2), the City is authorized <br />19 to adopt new service charges as set forth herein to cover such costs incurred by the City. <br />BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />20 <br />21 1. Notice of the public meeting and public hearing at which this Resolution <br />22 was considered was properly given and all oral and written presentations made to and heard <br />by the City Council were properly considered. <br />23 <br />24 2. The cost estimates considered by the Council are reasonable cost <br />estimates for the provision of such City services. <br />25 <br />26 3. There is a reasonable relationship between the fees to be collected for <br />27 the provision of various City services as identified in the data made available to the public. <br />4. The fees and fee increases set forth in Exhibit "A" do not exceed the <br />28 <br />actual or estimated cost of the provision of the public services to which they relate. <br />RVPUB\jB\625047 <br />
