RESOLUTION NO. R-48-02 <br />1 <br />2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, CALIFORNIA UPHOLDING THE PLANNING <br />3 COMMISSION'S DENIAL OF FILE INDEX NUMBER DCV98-01, AND <br />DENYING A REQUEST TO CONSTRUCT AN ELECTRONIC <br />4 MESSAGE BOARD AND FIVE (5) BILLBOARD SIGNS <br />5 WHEREAS, East Valley Land Company filed major variance, conditional use permit <br />6 <br />and environmental assessment applications ("File Index No. DCV -98-01) to permit construction of an <br />7 <br />electronic message board and five (5) off-site advertising (billboard) displays, including the <br />8 <br />reconstruction of one billboard display ("Application"), on property located on the west side and <br />9 <br />parallel to the 1-215 Freeway between Cooley Drive and the Reche Canyon Flood Control Channel <br />10 <br />(APN 276-131-85) ("Subject Site"); and <br />11 WHEREAS, the Application was referred to all affected public agencies; and <br />12 <br />WHEREAS, on March 26, 2002 and April 9, 2002, the Planning Commission ofthe City <br />13 <br />of Colton ("Planning Commission") conducted duly noticed public hearings on the Application atwhich <br />14 <br />time all persons wishing to testify in connection with the Application were heard and the Application <br />15 <br />was comprehensively reviewed; and <br />16 <br />WHEREAS, the Application was reviewed, studied, and was denied by the Planning <br />17 <br />Commission as being inconsistent with the City's adopted General Plan and not meeting the <br />18 <br />requirements of the Colton Municipal Code; and <br />19 <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have <br />20 <br />occurred. <br />21 BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />22 <br />Section 1. Based on the entire record before the City Council and all written and oral <br />23 <br />evidence presented, including the staff report, the City Council hereby upholds the Planning <br />24 <br />Commission's denial of File Index No. DCV -98-01 and denies the appeal for the reasons set forth <br />25 <br />below: <br />26 <br />A. The City Council makes the following findings in accordance with Colton <br />27 <br />Municipal Code Section 18.58.040 as follows: <br />28 <br />1. The proposed Application is not in accord with the general plan, the objectives <br />of the zoning ordinance and the purposes of the zone in which the site is located. The <br />-1- <br />
