R-105-22 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY .OF COLTON$ <br />CALIFORNIA,: APPROVING. A DONATION AGREEMENT BY AND BETWEEN <br />THE CITY OF COLTON AND T.A..BBAA..FAMILY LIMITED PARTNERSHIP; AND. <br />EXECUTING AND ACCEPTING DONATION AGREEMENT AND RELATED <br />DOCUMENTS AND FINDING THE AGREEMENT AND RELATED DOCUMENTS <br />EXEMPT FROM REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL <br />.QUALITY ACT (CEQA) PURSUANT TO STATE CEQA GUIDELINES SECTIONS <br />15301,.15304, 15307,15308, and 15061(b)(3.) <br />WHEREAS; the City of Colton (City) is a California municipal corporation that :owns <br />and operates land within San Bernardino County and seeks to acquire additional lands for <br />their City; and <br />WHEREAS, property owner Tabbaa Family Limited Partnership, wishes to convey to <br />the City 1.1 acres of real property located in San Bernardino County, identified as Assessor <br />Parcel Nos. 0254-061-03 (the Property); and <br />WHEREAS, conveyance of the property to the City would be for the purpose of <br />wildlife and plant life conservation pursuant to the West Valley Habitat Conservation Plan; <br />and <br />WHEREAS, to effectuate the conveyance of the .Property and to ensure the <br />preservation of the Property in: its natural state in perpetuity, a Donation Agreement and <br />related documents:.will be executed and accepted by the City, and <br />WHEREAS; execution of the Donation Agreement and related documents will <br />prevent any future use of the Property that would impair or interfere with the Property's <br />conservation values, and will confme% the. use of the Property to such activities. that are <br />consistent with preservation, restoration, and enhancement of native species and their <br />habitats. <br />NOW,. THEREFORE, BE IT RESOLVED by the City Council of the City of Colton, as <br />follows: <br />SECTION 1. RECITALS. The recitals and findings preceding this Resolution are <br />true and correct and are incorporated into this Resolution by this reference. <br />SECTION 2: CE A NOTICE OF EXEMPTION City finds that execution and <br />acceptance of the Donation. Agreement and related documents is exempt from further <br />environmental review under: the California Environmental. Quality Act ("CEQA") pursuant <br />to the following sections of the State CEQA Guidelines (Cal. Code Regs., tit. 14, § 1500.0 <br />et seq.): sections 15301 (existing facilities), 153.04 (minor alterations to land), 15307 <br />(actions for. protection of natural resources), and 15308 (actions. for the protection of the <br />P] <br />
