None of the exceptions to these categorical exemptions apply, and consequently, these actions are exempt from further CEQA Review. SECTION 3. APPROVAL OF AGREEMENT. The City hereby approves the Donation Agreement in substantially the forri-i attached hereto as Exhibit "A" by and between the City of Colton and the Tabbaa Family Lirnited Partnership, for the donation of the Donor Property. SECTION 4. AMEND THE FY 2022-23 BUDGET. The City Council authorizes an increase in revenues in account number 10-7847-000 by the current fair market value, $22,870, of the land. SECTION 5, IMPLEMENTATION. The City Manager, or a designee, is hereby authorized to execute, accept, or otherwise effectuate the Donation Agreement and related documents for the Property, and to execute such other documents necessary to carry out the conveyance of the Property to the City, subject to any further revisions to the Donation Agreement and related documents deemed necessary by the City Manager and legal counsel. SECTION 6. SEVERABILITY. If any provision of this Resolution or the application of any such provision to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are severable. City declares that City would have adopted this Resolution irrespective of the invalidity of any particular portion of this Resolution. SECTION 7. CERTIFICATION. The City Clerk shall certify to the adoption of this Resolution and this Resolution shall become effective immediately upon its adoption.
