R-44-01 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON INITIATING PROCEEDINGS TO <br />DISCONTINUE AND ABANDON THE USE AS A PUBLIC <br />PARK A PORTION OF VETERANS PARK <br />WHEREAS, the City of Colton ("City") owns certain real property located at 294 East <br />"O" Street, Colton, California, more commonly known as Veterans Park and more specifically <br />described in Exhibit "A", attached hereto and incorporated herein by reference ("Veterans <br />Park"), which is currently used for public park and related purposes; and <br />WHEREAS, a portion of Veterans Park that is approximately 27,000 square feet and <br />is more specifically described in Exhibit "B", attached hereto and incorporated herein by <br />reference ("Parcel A") is currently used as a parking lot for Veterans Park; and <br />WHEREAS, FHJ General Partnership ("Property Owner") owns certain real property <br />located immediately adjacent to Parcel A that is approximately 70,200 square feet in size <br />("Parcel B"); and <br />WHEREAS, Property Owner has agreed to transfer Parcel B to the City to be used for <br />park purposes in exchange for the City's conveyance of Parcel A to Property Owner; and <br />WHEREAS, if exchanged, Property Owner intends to use Parcel A to expand <br />Property Owner's existing manufacturing business; and <br />WHEREAS, pursuant to California Government Code section 38440 et seq., the City <br />may convey a minor portion of a public park in exchange for an equal or greater area or <br />value of privately owned land contiguous to the park if that portion of the public park is <br />discontinued and abandoned pursuant to the provisions of California Government Code <br />section 38440 et seq. and if the City Council determines that the exchange is in the public <br />interest and convenience; and <br />WHEREAS, the City desires to initiate proceedings to discontinue and abandon that <br />portion of Veterans Park described herein as Parcel A; and <br />RVPUBVR\230 <br />1 <br />
