1 EXHIBIT A" <br /> 2 CONDITIONS OF APPROVAL <br /> THE APPLICANT SHALL COMPLY WITH ALL CONDITIONS AS SET FORTH IN THE <br /> 3 CONDITIONS OF APPROVAL FOR DAP24-0007: <br /> 4 <br /> HOLD HARMLESS <br /> 5 <br /> 6 1. The Applicant shall defend, indemnify, and hold harmless the City of Colton and its officers, <br /> 7 employees, and agents from and against any claim, action, or proceeding against the City of <br /> Colton, its officers, employees, or agents to attacks, set aside, void, or annul any approval or <br /> 8 condition of approval of the City of Colton concerning this project, including but not limited <br /> to any approval or condition of approval of the city council, planning commission, or <br /> 9 development services director. The City shall promptly notify the Applicant of any claim, <br /> action, or proceeding concerning the project and the City shall cooperate fully in the defense <br /> 10 of the matter. The City reserves the right, at its own option, to choose its own attorney to <br /> 11 represent the City, its officers, employees, and agents in the defense of the matter. <br /> 12 PLANNING DIVISION <br /> 13 <br /> 14 1. This approval is for Modification of Architectural and Site Plan Review(DAP-001-716) for a <br /> 456,445 square foot warehouse building including ancillary office space, located at 1400 Agua <br /> 15 Mansa Road on property measuring approximately 19.39 acres of land within the M-2 (Heavy <br /> Industrial)Zone (New Case Index No. DAP24-0007). <br /> 16 <br /> 17 2. All previous approved resolutions with findings, environmental determinations, & conditions <br /> of approval along with approved development plans (as amended) shall continue to be met and <br /> 18 in force including R-09-23 (DAP-001-716) and related to architectural plans associated with <br /> approved zoning entitlements shall continue to be in force, except as modified herein. <br /> 19 <br /> 20 PUBLIC WORKS ENGINEERING <br /> 21 1. Public Works Engineering Condition of Approval 1.b.) of Planning Commission Resolution <br /> No. R-09-23 is hereby replaced and amended to read as follows: <br /> 22 <br /> Construct missing street improvements along the project frontage (along Agua Mansa Rd.) <br /> 23 consisting of curb, gutter, sidewalk, A.C. pavement, driveway approaches, handicap access <br /> 24 ramps, streetlights, street signs, and roadway striping, etc., as per the approved Street <br /> Improvement Plans and City of Colton Standard Specifications. This includes dedication of <br /> 25 necessary right of way of 66-feet for street width and three(3) additional feet for a landscaping <br /> easement along the entire south side of the entire project frontage to be maintained by the <br /> 26 developer. <br /> 27 <br /> 28 <br />
