1 5. The exterior design of the buildings and structures will not be injurious or detrimental to <br /> the environmental or historic features of the immediate neighborhood in which the <br /> 2 proposed Project is located and will not cause irreparable damage to property in the <br /> 3 neighborhood, to the City and to its citizens; in that proposed Modification of Architectural <br /> and Site Plan Review will have no changes to the exterior design of the buildings and <br /> 4 structures approved by the Planning Commission on May 9, 2023 and as upheld by the City <br /> Council on June 20, 2023. The proposed changer will only amend and correct Public Works <br /> 5 Engineering Condition of Approval 1.b.). <br /> 6 6. The proposed Project will not impose an undue burden upon off-site public services, <br /> including sewer, water and streets, which conclusion shall be based upon a written report <br /> 7 of the City Engineer; and there is provision in the capital works program of the City to <br /> 8 correct the specific burden within a reasonable period after the Project will be complete; in <br /> that the off-site improvements will continue to be met and no undue burden will be created as <br /> 9 correction to Public Works Engineering Condition of Approval 1.b.) only relates to correcting <br /> street dedication of necessary right of way which will still allow for completion of required <br /> 10 services for the project within a 66-foot half street right of way instead of 90-feet wide. <br /> 11 SECTION 9. Based upon the findings set forth in Sections 3, and 8 of this Resolution, the <br /> City Council hereby approves Modification of Architectural and Site Plan Review(DAP-001-716) <br /> 12 to allow the construction of a 456,445 square foot, 50 foot high, warehouse/office building and <br /> associated site improvements, on property measuring approximately 24 acres in an area located at <br /> 13 1400 Agua Mansa Road in the M-2 (Heavy Industrial) Zone, subject to the attached conditions of <br /> 14 approval (DAP24-0007) (Exhibit "A"). This modification to Public Works Condition of Approval <br /> 1.b.) does not result in any changes to the environmental analysis. <br /> 15 SECTION 10. The City Clerk shall certify to the adoption of this Resolution. <br /> 16 <br /> 17 SECTION 11.
