It also provides for additional three-year <br />extensions subject to review by the Community Development Director and approval of a Nonconforming <br />Extension. Such extensions could continue to be granted indefinitely. <br />The proposed ordinance promotes the continuation of nonconforming structures for housing, including low income, <br />and low and moderate -income housing within the City. In addition, the proposed ordinance helps to promote and <br />achieve policy objectives of the Housing Element of the General Plan, pertaining to the maintenance of existing <br />housing stock for low income and low and moderate -income persons. <br />On July 10, 2001, the Planning Commission conducted a Public Hearing to consider the proposed ordinance. The <br />Commission unanimously voted approval of File Index Number DO -33-01, and adopted Resolution Number R-05- <br />01, recommending to the City Council approval of an ordinance to add Section 18.46.070 to the Colton Municipal <br />Code. Since the Planning Commission took action, the City Attorney made minor, non -substantive revisions to the <br />proposed Ordinance, which changes are reflected in the draft attached hereto. <br />ENVIRONMENTAL IMPACT: <br />There is no environmental impact. The proposed ordinance is Exempt under Section 150061 (b) (3) of the <br />California Environmental Quality Act (CEQA). <br />FISCAL IMPACT: <br />Applicants for Nonconforming Extensions will be required to obtain an inspection by the Building Division of the <br />Community Development Department in order to evaluate the physical conditions of the residential structure and <br />advise the Design Review Committee in making their determination concerning whether the nonconforming <br />residential structure will be detrimental to the public health, safety and welfare, or materially injurious to properties <br />or improvements in the vicinity. The inspection fee, which is an existing inspection fee already adopted by the City <br />Council, will generate minimal revenue for the City General Fund. <br />RECOMMENDATION: <br />Staff recommends the City Council approve File Index Number DO -33-01; accept Planning Commission <br />Resolution Number R-05-01; waive Full Reading and Pass First Reading of the proposed Ordinance (Adding <br />Section 18.46.070 to the Colton Municipal Code Relating to Extension Periods for the Continuation of <br />Nonconforming Structures used for Residential Purposes); and, direct staff to file the Notice of Exemption with the <br />County Clerk. <br />Attachments: Planning Commission Resolution R-05-01 <br />Ordinance <br />REVIEW TEA1V)['ONLY <br />City Attorney: ' r �� V Finance Director: <br />City Manager: OTHER- <br />
