R-05-01 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF COLTON RECOMMENDING TO THE COLTON <br />CITY COUNCIL APPROVAL OF AN ORDINANCE TO ADD <br />SECTION 18.46.070 TO THE COLTON MUNICIPAL CODE, <br />RELATING TO EXTENSION PERIODS FOR THE <br />CONTINUATION OF NONCONFORMING STRUCTURES <br />USED FOR RESIDENTIAL PURPOSES, FILE INDEX NO. DO - <br />33 -01 <br />WHEREAS, the City of Colton Planning Commission (the "Planning <br />Commission") held a public hearing on July 10, 2001, after giving published notice, of an <br />ordinance to add Section 18.46.070 to the Colton Municipal Code relating to extension periods <br />for the continuation of nonconforming structures used for residential purposes (the "Zone Text <br />Amendment"); and <br />WHEREAS, the Planning Commission has determined that the Zone Text <br />Amendment is consistent with the City of Colton General Plan for the reasons set forth in the <br />proposed ordinance; and <br />WHEREAS, the Planning Commission has determined that the proposed Zone <br />Text Amendment is in the best interests of the City, promotes the public health, safety and <br />welfare of the community and would be in the public interest to recommend approval of the <br />Zone Text Amendment; <br />BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />Section 1. The Planning Commission hereby recommends that the City <br />Council adopt an ordinance amending Title 18, Chapter 18.46 by adding Section 18.46.070 - <br />"Continuation of nonconforming structures for residential purposes." A copy of the ordinance is <br />attached hereto as Exhibit "A" and is incorporated herein by this reference. <br />Section 2. The Planning Commission hereby determines that this proposed <br />Zone Text Amendment warrants the filing of a Notice of Exemption pursuant to Section 15061 <br />(b)(3) of the State of California Environmental Quality Act ("CEQA") Guidelines and the City of <br />Colton's implementing procedures for CEQA. The Planning Commission hereby recommends <br />that the City Council approve a Notice of Exemption for the proposed Zone Text Amendment. <br />
