DISCUSSION/ANALYSIS: <br />Section 5.32.030, subsection "C" of the Colton Municipal Code provides that the City <br />Council may set the amount of the application fee for dance permits. However, there <br />are no existing provisions in the Colton Municipal Code for establishing an application <br />fee for pawnbroker permits. In addition, Section 5.24.030, subsection "D" of the Colton <br />Municipal Code provides an application fee of $25 for massage permits. This amount is <br />well below the estimated cost for processing such permit applications and therefore <br />should be adjusted so that the City may recover its actual processing costs. <br />The adjustment for massage permit fees and a provision for establishing application <br />fees for pawnbroker permits is contained in the attached proposed ordinance, which <br />amends chapters 5.20 and 5.24 of the Colton Municipal Code. The proposed <br />ordinance provides that application fee amounts for massage permits and pawnbroker <br />permits will be established by resolution, similar to the provision for dance permit <br />applications in Section 5.32.030 of the Colton Municipal Code. In accordance with the <br />Colton Police Department's data, the proposed resolution establishes a standard <br />application fee amount of $165 for the three types of permits described here. <br />In addition, the proposed ordinance amends the regulations for pawnbroker permits to <br />allow the permit application to be submitted to the Chief of Police, rather than the City <br />Council. The amended language makes this section of the Colton Municipal Code <br />consistent with the application requirements for dance permits and massage permits. <br />The proposed ordinance also provides an appeal process for pawnbroker permits, <br />similar to the appeal process for dance permits and massage permits. To clarify <br />specific terms used, the proposed ordinance references definitions in state law for "junk <br />dealer," "junk collector," "secondhand dealer," and "pawnbroker." The proposed <br />ordinance also revises section headings to consistently use the specified terms. <br />Finally, the proposed ordinance removes language that requires written consent from <br />property owners and tenants within 500 feet of a proposed pawnshop. This language <br />was adopted in 1940 and has since been rendered obsolete by case law. Specifically, <br />the City cannot make third party 'approval part of the permit process. The proposed <br />ordinance removes this language and improves the City's regulations for pawnbroker <br />permits. <br />In addition to updating regulations for pawnbroker permits, adopting both the proposed <br />ordinance and resolution will allow the City to recover its costs for processing <br />applications for dance permits, massage permits and pawnbroker permits. <br />ALTERNATIVES: <br />1.
