CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF October 15, 2002 <br />TO: Honorable Mayor and City Council <br />APPROVAL: Daryl Parrish, City Manager <br />FROM: City Attorney <br />SUBJECT: Adoption of Uniform Codes <br />DATE: <br />BACKGROUND: <br />October 4, 2002 <br />On October 1, 2002, the City Council conducted first reading of two ordinances adopting, <br />by reference, the California Building Code and the California Fire Code. At the same <br />meeting, the City Council scheduled the public hearing for these ordinances for October <br />15, 2002. The adoption of these ordinances is necessary in order to implement the <br />updated standards governing construction practices approved by the California Building <br />Standards Commission. These ordinances include the more stringent local amendments <br />based on local geological, topographical and/or climatic conditions particular to the City of <br />Colton. <br />DISCUSSION/ANALYSIS: <br />Adoption of these codes and the local amendments is designed to provide consistency in <br />the application and enforcement of building and housing standards with a particular <br />emphasis on local needs. If the City Council determines not to adopt these Ordinances, <br />the uniform codes, without the local amendments addressing the City of Colton's local <br />conditions, would apply. Adopting these uniform codes without local amendments would <br />restrict the City's ability to enforce life and property safety requirements based on local <br />conditions and the specific needs of the City of Colton. <br />State law requires that the City publish a notice of the public hearing on the Ordinances <br />adopting the California Building Code and the California Fire Code twice in a local <br />newspaper at least 14 days before the public hearing. Through a clerical error, the notice <br />of public hearing for the Ordinance adopting the California Fire Code was not published <br />prior to this hearing. Therefore, it is necessary for the City Council to continue the public <br />hearing on the Ordinance adopting the California Fire Code to November 5, 2002. <br />However, since the public hearing notice for the California Building Code Ordinance was <br />properly published, that Ordinance may be adopted at the conclusion of the public hearing. <br />ALTERNATIVES: <br />
