3.2 Exhibit `B" of the Agreement is hereby amended to increase the number of hours per week from 20 to 40 and to change "Electric Utility General Manager" to "Utility Director," and is restated in its entirety to read as follows: "EXHIBIT `B" SCHEDULE OF SERVICES It is intended for the Consultant to provide engineering services on-site, at 150 S. 10' Street, Colton, CA 92324, forty (40) hours per week. Projects will be assigned as determined by the Electric Utility Director." 3.3 Exhibit "C" of the Agreement is hereby amended to increase the total contract price from $52,000 to $82,000 and is restated in its entirety to read as follows: "EXHIBIT "C" COMPENSATION Consultant shall bill for actual hours worked at the rate of $50.00 per hour, not to exceed eighty-two thousand dollars and zero cents ($82,000.00) in any contract period." 3.4 Continuing Effect of Agreement. Except as amended bythis First Amendment, all provisions of the Agreement shall remain unchanged and in full force and effect. From and after the date of this First Amendment, whenever the term "Agreement" appears in the Agreement, it shall mean the Agreement as amended by this First Amendment 3.5 Affirmation of Agreement. City and Consultant each ratify and reaffirm each and every one of their respective rights and obligations arising under the Agreement. Each parry represents and warrants to the other that there have been no written or oral modifications to the Agreement apart from this First Amendment.
