ITEM #1 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF JULY 18,2006 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: AMER JAKHER, P.E., PW DIRECTOR / CITY ENGINEER <br />SUBJECT: APPROVE RESOLUTION AMENDING THE FISCAL YEAR 2006/2007 <br />BASIC FEE FOR STORMWATER MANAGEMENT AND THE <br />STORMWATER MANAGEMENT FEE. <br />DATE: JULY 10, 2006 <br />BACKGROUND: <br />As a result of a State requirement issued by the California Regional Water Quality Control Board <br />the County of San Bernardino drafted an Implementation Agreement related to the <br />implementation of the National Pollutant Discharge Elimination System (NPDES). This <br />Agreement was executed in October 1990. Through this Agreement the San Bernardino County <br />Flood Control District was issued a five-year NPIDES Stormwater Permit, with 16 incorporated <br />cities as Co -Permittees. As this permit is renewable every five years, the City is currently <br />operating under its fourth permit effective thru October 2010. <br />The establishment of this Agreement requires the City to perform regular inspections and water <br />quality monitoring. These services are funded as authorized by Chapter 14.01 of the City's <br />Municipal Code; originated by Ordinance 0-20-96. Each property owner is assessed a <br />Stormwater Management Fee based upon the land use and size of the property. The average <br />residential Stormwater Management Fee for fiscal year 2005 was $25.00. <br />DISCUSSION/ANALYSIS: <br />The public hearing date for the Stormwater Basic Fee and Stormwater Management Fee was set <br />on May 2, 2006 and has since been published in the local newspaper. There is no increase in <br />either the "Basic Fee for Stormwater Services" or "Stormwater Management User Fee." However, <br />San Bernardino County has updated their system and identified some parcels that were not <br />charged at their appropriate parcel size in previous years that will experience an increase. Aside <br />from these parcels, landowners who have not changed their property usage will not receive an <br />increase over last year's fees. Additionally, as a result of recent annexations additional parcels <br />have been included in the fee table, Exhibit A' which were not included in last years fee table <br />submittal to the County. These fees affect only developed parcels. The fees collected this year <br />will fund the Stormwater Division for FY 06-07, which includes the City's operational costs for <br />street sweeping, storm drain cleaning, roadway maintenance and litter control. <br />7/10/03 City Clerk's Office Cb <br />
