1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-14-06 <br />AN ORDINANCE OF THE OF THE CITY COUNCIL OF THE CITY <br />OF COLTON TO AMEND THE TRAFFIC IMPACT FEES <br />DESCRIBED IN EXHIBITS "A" AND "B" OF ORDINANCE 0-02- <br />00, ADOPTED BY THE CITY OF COLTON ON MARCH 21, 2000 <br />WHEREAS, the City Council of the City of Colton (the "City Council") previously <br />adopted Ordinance No. 0-02-00 on March 21, 2000 enacting development impact fees, including <br />traffic impact fees, to finance certain public facilities and improvements; and <br />WHEREAS, the City Council also adopted findings and fees to mitigate traffic <br />impacts based upon a 1993 document prepared by the traffic engineering firm of Mohle, Grover <br />and Associates, which was revised and updated by City staff in 1999 (collectively referred to as <br />the "Mohle-Grover Study); and <br />WHEREAS, the Mohle-Grover Study identified the need for traffic improvements <br />necessitated by new development in the City; and <br />WHEREAS, when the City Council adopted the traffic impact fees ("Traffic Impact <br />Fees"), they opted to reduce the amount of the fee justified by the Mohle-Grover Study and <br />adopted a lesser amount to ensure that there was a balance between meeting the traffic needs <br />of the community and attracting new development to the City; and <br />WHEREAS, since the adoption of the reduced Traffic Impact Fees in 2000, the <br />City has not increased or adjusted the Traffic Impact Fees to reflect increased costs for <br />construction, labor and materials; and <br />WHEREAS, pursuant to Government Code Section 66000 et. seg., the City is <br />empowered to impose new and revise existing development fees and other exactions to provide <br />necessary public facilities required to mitigate the impacts of new development; and <br />WHEREAS, the rate of construction and growth continues to drive the demand for <br />municipal services which generates the need to expand the City's public facilities in order to <br />provide those services; and <br />ORANGEWMMARTNEZ\27431.1 <br />
