1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, the Traffic Impact Fees adopted in 2000, which are contained in <br />Section 11 and Exhibits "A" and "B" of Ordinance No. 0-02-00, are significantly lower than what <br />was found to be appropriate fee levels and are thus incapable of generating amounts needed to <br />pay for the traffic improvements required to sustain needed levels of business and economic <br />development; and <br />WHEREAS, the City Council finds it reasonable and prudent to adjust the Traffic <br />Impact Fees for inflation, using the Construction Cost Index, an industry standard index <br />published in the Engineering News Report ("Data"); and <br />WHEREAS, the revised Traffic Impact Fees, the Mohle-Grover Study and Data <br />comply with California Government Code, Section 66001 by establishing the basis for the <br />imposition of the fee. In particular, they: <br />1. Identify the purpose of the revised fees; <br />2. Identify the use to which the fees will be put; <br />3. Demonstrate a reasonable relationship between the fees' use and the <br />types of projects upon which the fees are imposed; <br />4. Demonstrate a reasonable relationship between the need for the public <br />facilities and the types of developments upon which the fees are imposed; <br />and <br />5. Demonstrate a reasonable relationship between the amount of the fees <br />and the cost of the public facilities or portions of the facilities attributable to <br />the development upon which the fees are imposed; and <br />WHEREAS, adjustment of the Traffic Impact Fees using the Construction Cost <br />Index provides a reasonable measure of the increases of labor, construction and materials costs <br />for traffic improvements. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF COLTON: <br />SECTION 1. Recitals. The City Council hereby finds that the above recitals are <br />true and correct and are incorporated herein as if fully set forth. The City Council further adopts <br />the findings contained in Section 5 of Ordinance No. 0-02-00 in support of the adjustment to the <br />Traffic Impact Fees based on the Construction Cost Index. <br />SECTION 2. Amendments to Ordinance No. 0-02-00. The City Council, finds <br />that the proposed Traffic Impact Fees, as set forth in Exhibit "A" and Exhibit "B" which are <br />attached hereto and incorporated herein by this reference, are reasonable and necessary to <br />support current and future development in the City of Colton. The City Council hereby adopts <br />the Traffic Impact Fees identified in the attached Exhibits "A" and "B" and hereby repeals the <br />ORANGE\MMARTINEZ\27431.1 - 2 - <br />
