the first census is taken or the first current population estimates are <br />obtained, following the annexation.... <br />If upon reexamination, the legislative body finds that the population <br />of the council district has varied so that the districts no longer meet <br />the criteria specified in Section 21601 [which discusses the <br />adjustment of councilmember districts post -federal census], the <br />legislative body shall, within 60 days after the census is taken, or <br />current population estimate is received, by ordinance or resolution, <br />adjust the boundaries of any or all the council districts of the city so <br />that the districts shall be as nearly equal in population as may be." <br />(California Elections Code § 21603). <br />Thus, if an annexation takes place between federal censuses (the 2000 and 2010 censuses, in <br />this case), the voters within the annexed area must be placed within the annexing city's council <br />districts. In addition, the annexing city must adopt an ordinance changing the boundaries of the <br />council districts to reflect the annexed territory. <br />ANALYSISMISCUSSION: <br />According to the San Bernardino County Registrar of Voters Office when Annexations Nos. <br />S-50 and S-51 took place, those populating the areas were placed into Colton's existing Council <br />Districts 5 and 6 as follows: <br />S-51: 46 Individuals <br />These individuals were added to Precincts 24 and 29, which are located in District 5. <br />S-50: 214 Individuals <br />These individuals were added as follows: <br />Sub -Area 1: Precinct 13 <br />Sub -Area 2: Precinct 13 <br />Sub -Area 3: Precincts 27 and 28 <br />Sub -Area 4: Precinct 14 <br />These precincts are all located in District 6. <br />As stated above, when annexing individuals into an existing Council District, Elections <br />Code Section 21603 requires that the City Council ensure that each Council District remain as <br />"nearly equal in population" as possible. In 2001, when the City redistricted after the 2000 <br />Federal Census, they placed approximately 8,000 people in each district; and, as such, the <br />addition of 46 people in District 5, and 214 people in District 6, will not result in such a <br />ORANGE\HKENNY\29777.5 <br />
