Staff Report to the Mayor and City Council <br />Permit Parking Ordinance <br />March 4, 2025 <br />Page 2 <br /> <br /> <br />parking permit zone in the City of Colton. <br /> <br />A review of the current Municipal Code Chapter was completed to identify necessary changes. <br />Staff found that the existing regulations under Colton Municipal Code Chapter 10.44 have <br />become complex, leading to administrative inefficiencies and confusion among residents <br />regarding eligibility, application, and enforcement of permits. This complexity also hampers <br />effective enforcement and equitable application of the parking rules. <br /> <br />Additionally, staff discovered Ordinance O-12-05 codified CMC 10.40 as the “Preferential <br />Parking Program.” However, Colton Municipal Code identifies CMC 10.40 as “Rotational <br />Towing Services.” It was discovered the “Preferential Parking Program” was placed in CMC <br />10.44. The proposed adoption of this revised ordinance will correctly establish CMC 10.44 as <br />the “Preferential Parking Code.” <br /> <br />ISSUES/ANALYSIS <br /> <br />Pursuant to California Vehicle Code Sections 22507 and 22507.5, the City of Colton may <br />regulate and manage parking to address local conditions, particularly in residential areas where <br />parking availability impacts quality of life. More specifically, the City may establish preferential <br />parking zones to provide parking to residents and mitigate the effects of non-resident parking. <br /> <br />Preferential parking zones are necessary to alleviate serious problems in certain residential ar eas <br />of the City due, in part, to the parking of motor vehicles on streets by nonresidents of the <br />immediate area for extended periods of time and the nonuse of available public transit <br />alternatives to automobile travel by nonresidents which has resulted in neighborhood decline in <br />affected areas because of traffic congestion, noise, air pollution, traffic hazards, and inability of <br />residents to park their vehicles reasonably close to their residences. During the review process, <br />numerous amendments were brought forth that are essential to refining the ordinance. The <br />revisions to the current ordinance include the following changes: <br /> <br />Petition forms. <br />The Police Department shall provide petition forms for preferential parking zones upon the <br />written request of any five (5) residents of/or property owners within a proposed zone, one (1) of <br />whom shall be designated in the request as the official representative of the zone advocates. <br /> <br />Establishment of a preferential parking zone. <br />Currently, preferential parking zones may be initiated by property owners or tenants. Under the <br />proposed ordinance, only property owners can petition for and establish these zones. More <br />specifically, the preferential parking zone establishment process may be initiated by petition <br />containing the signatures of at least seventy five percent (75%) of the property owners of all <br />units of occupancy fronting curbs proposed to be included in the zone. The petition form is <br />provided by the Police Department. The signed and completed petition shall be submitted to the <br />Police Department. <br />1 <br />Packet Pg. 8
