R-24-25 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, APPROVING THE SUMMARY VACATION OF A CITY - <br />OWNED RIGHT-OF-WAY PARCEL LOCATED AT 910 HERT STREET, <br />PURSUANT TO CALIFORNIA STREETS AND HIGHWAYS CODE <br />SECTIONS 8330 ET. SEQ. <br />THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS: <br />A. The City proposes to summarily vacate and declare as "exempt surplus land" a <br />parcel of City -owned right-of-way property that is approximately 15,200 square feet in size <br />(0.35 acres) and is located at 910 Hert Street; and <br />B. Pursuant to California Streets and Highways Code section 8334(a), the City Council <br />may summarily vacate an excess right-of-way of a street or highway not required for street <br />or highway purposes; and <br />C. The two neighboring streets (Hert St. and La Cadena Drive) have already been <br />developed to their maximum street widths per the City's General Plan, the property is not <br />necessary for street or highway purposes and the City has been requested to negotiate a sale <br />of it to the neighboring property owner to the north for development of a potential housing <br />project. <br />D. This summary vacation is being conducted pursuant to Sections 8330 et. sue. of <br />California Streets and Highways Code, said right of way property being described in <br />attached Exhibit "A", within the City of Colton, San Bernardino County, State of California; <br />and <br />E. In accordance with Government Code Section 65402, on March 11, 2025, the Colton <br />Planning Commission adopted a resolution noting that the proposed summary vacation and <br />exempt surplus property declaration of the right of way located at 910 Hert St. is consistent <br />with the Colton General Plan and directed staff to report the findings of the Planning <br />Commission made in Planning Commission Resolution No. R-03-25 to the Colton City <br />Council; and <br />F. On April 15, 2025, the Colton City Council held a regularly scheduled meeting <br />where all interested persons had an opportunity to appear and to present testimony and <br />evidence regarding the matter of the proposed summary vacation; and <br />G. Staff have notified all known local utility companies of the proposed summary <br />vacation of 910 Hert St.; and <br />H. No utility facilities or easements are known to exist in the area being summarily <br />vacated with this action and all public utilities approved the requested summary vacation <br />with no reservations by citing no facilities in the area; and <br />I. Pursuant to the California Environmental Quality Act (Public Resources Code <br />Section 21000 et seq.) ("CEQA"), the City Council finds that the mere summary vacation <br />
