ITEM #4 <br />ORDINANCE NO. O-19-06 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />COLTON APPROVING A CHANGE OF ZONE FROM PF <br />(PUBLIC FACILITY) TO IP (INDUSTRIAL PARK) FOR <br />PROPERTY LOCATED AT WEST TROPICA RANCHO ROAD <br />IN THE CITY OF COLTON: DAP -000-507 <br />WHEREAS, Medlin Development filed an application (File No. DAP -000-507) <br />requesting a zone change from PF (Public Facility) to IP (Industrial Park) ("Application") for <br />property located at West Tropica Rancho Road (Assessor Parcel No. 0163-351-024) in the City <br />of Colton, County of San Bernardino ("Subject Site"); and <br />WHEREAS, the Application was reviewed, studied, and found comply with the <br />California Environmental Quality Act ("CEQA") as more fully described below; <br />WHEREAS, on September 12, 2006, the Planning Commission of the City of <br />Colton ("Planning Commission") conducted a duly noticed public hearing on the Application at <br />which time all persons wishing to testify in connection with the Application were heard and the <br />Application was fully studied; <br />WHEREAS, the Planning Commission adopted a Resolution recommending <br />approval of this Zone Change to the City Council of the City of Colton ("City Council"); <br />WHEREAS, on October 3, 2006, the City Council conducted a duly noticed <br />public hearing on the Application at which time all persons wishing to testify in connection with <br />the Application were heard and the Application was fully examined; and <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have <br />occurred; <br />FOLLOWS: THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS <br />SECTION 1. Based on the entire record before the City Council, all written and <br />oral evidence presented to the City Council, and the findings set forth in this Ordinance, the City <br />Council of the City of Colton hereby designates the Subject Site shown on the attached Exhibit <br />Al as within the IP (Industrial Park) zoning district as defined in Title 18, Chapter 18.24 of the <br />Colton Municipal Code. <br />SECTION 2. Based on the entire record before the City Council and all written <br />and oral evidence presented, the City Council finds the Zone Change is consistent with the <br />General Plan of the City of Colton because designation of the Subject Site within the IP <br />(Industrial Park) zoning district provides for land uses compatible with surrounding property and <br />the Colton Municipal Code. <br />RV PUB\HSHANE\720095.1 <br />
