ITEM #4 ORDINANCE NO. O-19-06 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON APPROVING A CHANGE OF ZONE FROM PF (PUBLIC FACILITY) TO IP (INDUSTRIAL PARK) FOR PROPERTY LOCATED AT WEST TROPICA RANCHO ROAD IN THE CITY OF COLTON: DAP -000-507 WHEREAS, Medlin Development filed an application (File No. DAP -000-507) requesting a zone change from PF (Public Facility) to IP (Industrial Park) ("Application") for property located at West Tropica Rancho Road (Assessor Parcel No. 0163-351-024) in the City of Colton, County of San Bernardino ("Subject Site"); and WHEREAS, the Application was reviewed, studied, and found comply with the California Environmental Quality Act ("CEQA") as more fully described below; WHEREAS, on September 12, 2006, the Planning Commission of the City of Colton ("Planning Commission") conducted a duly noticed public hearing on the Application at which time all persons wishing to testify in connection with the Application were heard and the Application was fully studied; WHEREAS, the Planning Commission adopted a Resolution recommending approval of this Zone Change to the City Council of the City of Colton ("City Council"); WHEREAS, on October 3, 2006, the City Council conducted a duly noticed public hearing on the Application at which time all persons wishing to testify in connection with the Application were heard and the Application was fully examined; and WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred; FOLLOWS: THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS SECTION 1. Based on the entire record before the City Council, all written and oral evidence presented to the City Council, and the findings set forth in this Ordinance, the City Council of the City of Colton hereby designates the Subject Site shown on the attached Exhibit Al as within the IP (Industrial Park) zoning district as defined in Title 18, Chapter 18.24 of the Colton Municipal Code. SECTION 2. Based on the entire record before the City Council and all written and oral evidence presented, the City Council finds the Zone Change is consistent with the General Plan of the City of Colton because designation of the Subject Site within the IP (Industrial Park) zoning district provides for land uses compatible with surrounding property and the Colton Municipal Code.
