SECTION 3. Based on the entire record before the City Council and all written <br />and oral evidence presented, the City Council finds the Zone Change is consistent with the City <br />of Colton General Plan ("General Plan"), and will implement the goals and objectives of the <br />General Plan. Moreover, the City Council hereby makes the following specific findings in <br />accordance with Section 18.58.050 of the Colton Municipal Code and state law: <br />A. The proposed zone change is in conformity with the General Plan of the <br />City because a general plan amendment has been approved concurrently with the zone change <br />request. The general plan amendment changes the land use designation of the Subject Site from <br />"Public Facility" to "Industrial Park". The proposed IP (Industrial Park) zoning designation is <br />consistent and in conformity with the proposed amended general plan designation. <br />B. There is a need in the community for more of the types of uses permitted <br />by the proposed zoning designation. The proposed IP (Industrial Park) zoning designation <br />permits beneficial use of the Subject Site, and provides additional commercial opportunities in <br />the City. <br />C. The proposed change of zone will not adversely affect the surrounding <br />area or the community in general. The IP (Industrial Park) zoning designation's development <br />standards provide adequate separation and height requirements to assure that proposed uses do <br />not significantly adversely affect surrounding areas. The proposed change of zone is consistent <br />with the zoning of property located to the east of the Subject Site. <br />D. The City Council has determined that the proposed zone change is in the <br />public interest because the Subject Site is not needed for expansion of adjacent public facility <br />uses, and allowing development of the Subject Site will provide for job creation and will be of <br />economic benefit to the City. <br />E. In considering this change of zone, the City has considered the housing <br />needs of the region and balanced those needs against the public service needs of the residents and <br />available fiscal and environmental resources. <br />SECTION 4. Based on the entire record before the City Council and all written <br />and oral evidence presented, the City Council finds the General Plan Amendment complies with <br />CEQA and hereby adopts the mitigated negative declaration (MND) and the associated <br />Mitigation Monitoring and Reporting Program (MMRP) for the following reasons: <br />A. The MND, MMRP and the initial study prepared for the Application <br />contain a complete and accurate reporting of the environmental impacts associated with the <br />Application. The documents have been completed in compliance with CEQA and the State <br />CEQA Guidelines. <br />B. The MND, MMRP and initial study prepared for the Application reflect <br />the independent judgment of the City Council. <br />C. As the decision making body for the Application, the City Council <br />reviewed and considered the information contained in the MND, the associated MMRP and the <br />initial study and administrative record prior to approving the Application. <br />RV PUB\HSHANE\720095.1 <br />
