D. All environmental impacts of the Application are insignificant and will be <br />mitigated to a level of insignificance. There is no substantial evidence in the record supporting a <br />fair argument that the Application will result in significant impacts. <br />E. The Application will not result in any changes to the following resources: <br />(1) riparian land, rivers, streams, watercourses and wetlands; (2) native and non native plant life <br />and the soil required to sustain habitat for fish and wildlife; (3) rare and unique plant life and <br />ecological communities dependent on plant life; (4) listed threatened and endangered plants and <br />animals and the habitat in which they are believed to reside; (5) all species listed as protected or <br />identified for special management in the Fish and Game Code, the Public Resources Code, the <br />Water Code or regulations adopted thereunder; (6) all marine and terrestrial species subject to the <br />jurisdiction of the Department of Fish and Game and the ecological communities in which they <br />reside; and (7) all air and water resources, the degradation of which will individually or <br />cumulatively result in a loss of biological diversity among the plants and animals residing in that <br />air and water. <br />SECTION 5. The zone change shall not become effective unless and until the <br />effective date of the corresponding general plan amendment for the Subject Site. <br />SECTION 6. The location and custodian of documents and any other material <br />which constitute the record of proceedings upon which the City Council based its decision to <br />adopt this negative declaration is as follows: David R. The City Council directs staff to file a Notice of Determination and <br />a Certificate of Fee Exemption (De Minimus Impact Finding) with the County of San Bernardino <br />within five (5) working days of project approval. <br />SECTION S. Effective Date. This Ordinance shall become effective thirty (30) <br />days after its adoption in accordance with the provisions of California law. <br />SECTION 9: The City Clerk shall certify to the passage of this Ordinance and <br />cause the same or a summary thereof to be published within fifteen (15) days after adoption in a <br />newspaper of general circulation, printed. and published in Colton, California. <br />PASSED, APPROVED, AND ADOPTED, this 3rd day of October, 2006. <br />Deirdre H.
