California Government Code, section 65858, authorizes the City Council to consider an <br />extension of an initial moratorium ordinance for an additional 10 months and 15 days after <br />providing newspaper notice of such extension in accordance with Government Code, <br />Section 65090. The attached urgency ordinance extends the Pellisier Ranch Area moratorium <br />by 10 months and 15 days. <br />DISCUSSION / ANALYSIS: <br />An extension of the Pellisier Ranch Area Moratorium is necessary to allow City Staff and <br />the City's consultants enough time to address and plan for appropriate land uses for the <br />Pellisier Ranch Area. Staff are continuing to work to develop appropriate land use <br />policies to guide development in the Pellisier Ranch Area. (See Attached Report in <br />Exhibit "B") The process of creating a Specific Plan takes a significant amount of time. <br />The specific conditions and issues which prompted the adoption of the Pellisier Ranch <br />Area moratorium will require particular attention and study in order for City Staff and <br />the consultants to properly address them. City Staff will seek public input on the land <br />use issues affecting the Pellisier Ranch Area. In the meantime, adoption of an extension <br />to the moratorium would prevent the approval of land uses, buildings and structures <br />that may be incompatible with these later -enacted regulations. Therefore, an extension <br />of the Pellisier Ranch Area Moratorium is necessary and appropriate in order to protect <br />the public health, safety and welfare from development of inappropriate land uses and <br />buildings. <br />Discussion of Exemptions <br />The Pellisier Ranch Area moratorium ordinance adopted by the City Council on October 17, <br />2006 includes 2 exemptions. The moratorium does not apply to (1) the issuance of building <br />and other permits issued for existing lawful uses and buildings that do not result in <br />expansion of the existing floor area of such uses or buildings in the Study Area; and (2) the <br />issuance of permits described in Colton Municipal Code Section 15.040.010, including <br />building, electrical, plumbing, mechanical and grading permits, for buildings and uses that <br />have received discretionary land use entitlement approvals on or before the effective date of <br />the urgency ordinance (October 17, 2006). <br />Since the adoption of the initial Pellisier Ranch Area moratorium, staff have met with several <br />owners of property within the Pellisier Ranch Area who are processing land use entitlement <br />applications.
