In accordance with Public Resources Code section 21081.6, the <br />City Council hereby adopts the MMRP previously adopted for the General Plan EIR as it <br />pertains to the Project. In the event of any inconsistencies between the Mitigation Measures as <br />set forth in the Section 15183 Analysis and the MMRP, the MMRP. <br />SECTION 5. LOCATION AND CUSTODIAN OF RECORDS. The documents and <br />materials that constitute the record of proceedings on which this Resolution has been based are <br />located at 659 N La Cadena Drive, Colton, CA 92324. The custodian for these records is <br />Development Services Department.. This information is provided in compliance with Public <br />Resources Code section 21081.6. <br />SECTION 6. NOTICE OF DETERMINATION. The City Council hereby directs <br />staff to prepare, execute, and file a Notice of Determination with the County Clerk's office and <br />the Office of Planning and Research within five (5) working days of adoption of this Ordinance. <br />SECTION 7. Pursuant to California Government Code Section 65865, the City <br />Council hereby approves the Development Agreement No. 0-03-26, attached hereto as <br />Exhibit "11-1", entitled "A Development Agreement No. 0-03-26 between City of Colton <br />and Lineage Logistics LLC, a Delaware limited liability company" attached herein in Exhibit <br />B-1 (aka "Agua Mansa Logistics Center, Building 1 Development Agreement") (the <br />"Development Agreement"). <br />SECTION 8. Based on the entire record before the City Council and all written and <br />oral evidence presented, the City Council finds this Development Agreement not be detrimental <br />to the health, safety and welfare of the community because the Development Agreement will <br />permit land uses that best reflect community needs, including the need for local employment <br />opportunities and increased property tax revenue to fund City services, and will allow for the <br />most efficient and logical development of the real property governed by the Development <br />Agreement in the City. <br />SECTION 9. Pursuant to California Government Code Section 65867.5(b), and based <br />on the entire record before the City Council, including all written and oral evidence presented, <br />the City Council hereby finds that the Development Agreement is consistent with the General <br />Plan because the Development Agreement will result in the development of the Property that is <br />consistent with the uses and intensity allowed under the General Plan. <br />SECTION 10 Based on the entire record before the City Council and all written and <br />oral evidence presented, the City Council finds that: (i) the economic interests of Colton citizens <br />and the public health, safety and welfare will be best served by entering into the Development <br />Agreement; (ii) this Development Agreement is compatible with the uses authorized in, and the <br />regulations prescribed for, the area in which the Property is located; (iii) the Development <br />Agreement is in conformity with the public convenience, general welfare and good land use <br />practice; and (iv) the Development Agreement will not adversely affect the orderly <br />development or the preservation of property values for the property it governs or any other <br />property. <br />The City Council further finds that among the public benefits to accrue to the residents of the <br />City as a result of the Development Agreement are: (a) A one-time payment of $4 million to <br />
