The proposed Ordinance would apply City-wide. To the extent any proposed <br />habitat conservation uses would occur on any sites included on any list <br />compiled pursuant to Section 65962.5 of the Government Code, the applicability <br />of this exception to that proposed use would be addressed during the <br />preliminary review for exemptions during the CUP process. (Section <br />18.31.040(G).) <br />(f) Historical Resources. A categorical exemption shall not be used for a project which may <br />cause a substantial adverse change in the significance of a historical resource. <br />The proposed Ordinance would apply City-wide. To the extent any proposed <br />habitat conservation uses would occur on any sites could include a historic <br />resource, the applicability of this exception to that proposed use would be <br />addressed during the preliminary review for exemptions during the CUP <br />process. (Section 18.31.040(G).) <br />Therefore, as analyzed above, no exceptions apply which would preclude the application of the <br />categorical exemptions to the proposed ordinance. <br />General Rule Exemption — State CEQA Guidelines Section 15061(b)(3) <br />Section 15061(b)(3) of the State CEQA Guidelines provides that an activity is exempt from CEQA <br />if: <br />The activity is covered by the general rule that CEQA applies only to projects <br />which have the potential for causing a significant effect on the environment. <br />Where it can be seen with certainty that there is no possibility that the activity in <br />question may have a significant effect on the environment, the activity is not <br />subject to CEQA. <br />As explained above, the proposed ordinance falls within several categorical exemptions. <br />Nevertheless, for all of the reasons described above, it can be seen with certainty that there is no <br />possibility that the proposed ordinance may have a significant effect on the environment. The <br />proposed ordinance provides a regulatory mechanism by which the City may ensure that land <br />within the City that is set aside as habitat for endangered species is properly managed to protect <br />the species and the surrounding environment. The ordinance also allows the City to incorporate <br />conservation efforts into its General Plan Update process. Thus, there is no possibility for adverse <br />impact. <br />CONFLICT OF INTEREST — Gift Disclosure Requirements <br />Not applicable. <br />
