That Roger Aguinaga applied for, and was granted, a conditional use permit for a Green <br />Waste Recycling Facility on-site plant nursery and caretakers unit on a 24.64 acres parcel. That <br />as used herein, reference to Roger Aguinaga also refers to Aguinaga Company, Inc., which <br />purports to be a corporation. <br />6. That said application was granted subject to the conditions set forth in the conditions of <br />approval attached hereto as Exhibit A. <br />17. That said approval was given on 10/12/04. <br />8. That a conditional use permit grants a right of operation within the City subject to <br />compliance with the conditions imposed. (Colton Municipal Code § 18.04.134, a certified copy <br />of which is attached hereto as Exhibit $ .) <br />9. That Roger Aguinaga has been in operation since 2004. <br />10. That Roger Aguinaga and persons working at this business have failed to comply with the <br />conditions of approval as follows: <br />Miscellaneous <br />11. There are no internally illuminated addresses have been installed that are visible from the <br />street. This is a violation of CUP condition #8. <br />12. That condition #9 provides that the business shall comply with all development <br />requirements of the Agua Mansa Industrial Corridor Specific Plan and Aguinaga failed to meet <br />the following conditions of that Specific Plan.
